Road 1341 as of March 2, 1951, be recorded in the Minutes of the Commis- sinners' Court, Nunc Pro Tunc, March 1951. ...- STATE OF TEXA5 ~ KNOW ALL MEN BY THESE ORESENTS: COUNTY OF KERR ~ THAT, the County Commissioners of Kerr County and Ernst Reeh and wife, Stella Reeh, have this day entered into the following agreement: Reference is here made to Right-of-Way Deed from Ernst Reeh and wife, Stella Reeh, to the State of Texas, bearing date of the 2nd day of March, A. D. 1951, covering a road-way through said Reeh's place as fully shown and described in the deed heretofore mentioned and this memorandum is made to show the consideration moving from Kerr County to said Reehs for said deed. Kerr County, through its proper officers, agree to make the following improvements through said Reehs property, said improvements to be made at the cost and expense of said County, as hereinafter set out, to-wit: The road which is 70 feet in width is to be fenced at the present time on the South side by moving present fence or fences now located on the property line between Wm. Lich r and Ernst Reeh replacing the necessary gates in said fence; and at such time as may be requested by the said Ernst Reeh and wife, Stella Reeh, in writing, build fences on the North and South side of the road through said Ernst Reeh's property, constructed of one strand barbed wire below netting and near the ground and immediately above will be the 4 ~ y netting, about 35 inches wide, and above the netting will be two strands of barbed wire. All wire will be of galvanized wire of standard weight and posts to be of good heart cedar. The County will construnt one underpass at location to be agreed upon between the County Commissioners Court and Ernst Reeh. Said underpass to be constructed as explained by Mr. Zeigler, Engineer of the Highway Department; and the underpass is to be constructed within a reasonable time after a request is submitted by Ernst Reeh in writing to the Commissioners Court of Kerr County, Texas. Necessary gates through said fences in said property, not to exceed 4 in number, and at locations to be designated by Ernst Reeh to the Commissioners Court shall be metal (aluminum gates) provided, however, that should said gates cost more than the "Cant-Sag" wooden gates treated with creosote, then said Reeh and wife agree to pay the excess in cost above the cost of the "Cant-Sag" gate. Said gates to be constructed within a reasonable time after a request is submitted by Ernst Reeh in writing to the Commissioners Court of Kerr County, Texas. This agreement will be carried into the minutes of Commissioners Court by proper resolution adopted by said Court and will be a public record as to the obligation of said County of Kerr.
