M. o-o-o-o-o-o-o-o-o-o THE STATE OF TEXAS ~ COUNTY OF KERR ~ THIS AGRI;F.ME'NT OF LEASE, made the 22nd day of December 1y71, by and between B. D. DRURY, hereinafter called L1;SSOR, and KERR COUNTY, TEXAS, a political subdivision of the ,- State of Texas, acting by and through its County Judge, hereunto duly authorized by the terms of the Commissioners Court, Order No. 11,473, duly entered on the 8th day of November, 1971 and recorded in Volume N, Page 228 of the minutes of the Court, hereinafter called LESSEE. WITNESSETH: 1. For and in consideration of the r,ovenants and agreements herein contained on the part of LESSEE to be kept and performed, LESSOR does hereby demise and lease unto LESSEE all that certain tract or parcel of land, together with the improvements thereon, such premises lying and being situated in Kerr County, Texas, and being 1,600 sauare feet of an 80' x 120' building (such area being designated on attached Exhibit "A") and located on the following described property, to-wit: All that certain tract or parcel of land, lying and being situated in the County of Kerr, State of Texas, and being Lots 387, 388 and 389, Block No. 52, Schreiner Second ^ Addition to the City of Kerrville, Kerr County, Texas, in accordance with the plat and plan of said addition of record in the Office o~' the County Clerk of Kerr County, Texas; and ?f -o known as ~tt_z Schreiner Street, Kerrville, Kerr County, Texas. 2. TO HAVE AND TO HOLD the said premises and improvements therein situated for a term of three (3} years, beginning upon the completion of a certain building to be erected on the hereinabove described property, and terminating three (3) Years thereafter unless other- wise terminated as provided for herein. (a) It is understood and agreed that when the building has been completed as herein- above referred to, the same shall be turned over to LESSEE and the rental referred to herein shall be immediately commenced. The rent to be paid under the terms of this lease is the sum of $160.00 per month payable as follows, to-wit: a prorata portion of the first months rent from the date of occupancy to the lst day on ensuing month and thereafter $160.00 per month on the 1st day of each month after said premises have been occupied for said month, that is to say, rent is payable after use and not payable in advance. 3. It is expressly agreed and understood that said premises hereby leased shall be used for the purpose of storage of records and election supplies and equipment of such County offices as designated by the LESSEE. 4. It is further understood and agreed that LESSEE will not sub-lease said premises, or -- any part thereof, to any person or persons whatsoever without the consent of the LESSOR in writing thereto first obtained. 5. It is expressly agreed and understood that the LESSEE shall at all times keep the premises hereby leased in a clean condition and will make all repairs and renewals necessary or advisable to keep said premises on the inside and all additions thereto from deteriora- ting in value or condition, reasonable wear and tear only excepted, and LESSOR shall be absolutely exempt from making any repair or renewal to said premises during the term of said lease on the inside of said building, except as may be herein provided. However, LESSOR shall maintain the structural condition of said building in as good condition as it is presently in, this to include the outside walls, roof, ceiling, roof frame work and the building structure. The LESSEE accepts the plumbing, lighting and heating unit as being in a good mechanical won};ing condition and covenants and agrees to maintain said equipment in same condition. The LESSEE being responsible for the normal, usual and customary maintenance and repair and LESSOR is responsible for all major repairs. 6. It is expressly agreed and understood that the LESSEE shall not make any structural changes on the inside of the building without the consent of LESSOR in writing being first obtained. It is further agreed that all fixtures which may be added to the building by the LESSEE may be removed by it at the termination of this lease, in which event the LESSEE shall leave the building in as good a condition as the same now is, reasonable wear and tear only excepted. Any improvements made by LESSEE which become permanently affixed to any part or portion of the premises herein. described shall. be and will remain as part of the premises and upon termination of t~is lease shall become the property of LESSOR. 7. It is expressly agreed and understood that LESSEE shall comply with all 5t ate, County and other laws and/or ordinances at all times during the life of this lease at its own V expense, as such laws shall apply to the LESSEE'S operation. ~~~ a. It is expressly agreed and understood that LESSOR may at any reasonable time enter into and upon the premises hereby leased and examine the condition of the same. 9. It is expressly agreed and understood that LESSEE shall pay the cost of all utilities on its portion of said building; save and except water which will be furnished by LESSOR. 10. Ii is expressly agreed and understood that in the event the building and premises, or any part thereof, shall, during the term of this lease, be destroyed or damaged by fire or inevitable accident, so that the same shall be therefore rendered unfit for use, then, and in that event, the rent hereinbefore provided for, or a just and proportionate part thereof, according to the nature and extent of the injuries sustained, shall be sus- pended or abated until LESSOR shall put the premises in a proper condition for LESSEES' use. However, in the event that the building shall be totally destroyed or destroyed to such an extent that it will require a new building, this lease shall be determined and ended at the election of LESSOR. 11. It is expressly agreed and understood that this lease is performable in Kerr County, Texas, and shall be binding upon -the heirs, executors, successors and administrators of the parties hereof.
