~~ 8. It i.s expressly agreed and understood that LESSOR may at any reasonable time enter into and upon the premises hereby leased and examine the condition of the same. 9. It is expressly agreed and understood that LESS~:E shall pay the cost of all utilities on its portion of said building; save and except water which will be furnished by LESSOR. 10. It is expressly agreed and understood that in the event the building and premises, or any part thereof, shall, during the term of this lease, be destroyed or damaged by fire or inevitable accident, so that the same shall be therefore rendered unfit for use, then, and in that event, the rent here~nbefore provided for, or a just and proportionate part thereof, according to the nature and extent of the injuries sustained, shall be sus- pended or abated until LESSOR shall put the premises in a proper condition for LESSEES' use. However, in the event that the building shall be totally destroyed or destroyed to such an extent that it will require a new building, this lease shall be determined and ended at the election of LESSOR. 11. It is expressly agreed and understood that this lease is performable in Kerr County, Texas, and shall be binding upon the heirs, executors, successors and administrators of the parties hereof.
