Order Requesting !;has. Schreiner Bank, Trustee of
the Charles Schreiner Road Fund, to Make Expendi-
ture of Accrued Earnings for the Purpose of Acquir-
ing Right-of-Way for State Highway No. 16 in Kerr
County
On this the 9th day of August, 1971 came on to be heard and con-
sidered by the Court, acting in its capacity as Advisory Trustees of the
Charles Schreiner Road Fund, pursuant to judgment entered in Cause No.
6127 on the docket of the Second Thirty-eighth District Court of Kerr County,
Texas, the matter of advising the Chas. Schreiner Bank of Kerrville, Texas,
Trustee of the Charles Schreiner Road Fund, as to the purposes for which
certain accrued earnings of said Trust Fund might be expended in furtherance
of the purposes for which said trust is created;
And it appearing to the Court that the Commissioners Gourt of Kerr
County is committed to secure additional right-of-way for the reconstruction
of State Highway 16 in Kerr County commencing at the city limits of the City
of Kerrville, at the intersection of F. M. Road 689 with said highway, and
running for a distance of 7 miles to the proximity of the intersection of F.
M. Road 1273 with said highway;
And it further appearing to the Gourt that all of the funds required
for such right-of-way procurement cannot be provided from the current reve-
nues of Kerr Gounty and that the improvement of the aforesaid portion of State
Highway 16 is essential to provide adequate access to and from the City of
Kerrville for the areas of development which this road serves, it is ordered
on motion by Commissioner Stone seconded by Commis-
sioner Bartel and unanimously approved by the Court that
the Commissioners Court of Kerr County, acting in its capacity as Advisory
Trustee of the Gharles Schreiner Road Fund, hereby recommends that the Chas.
Schreiner Bank of Kerrville, Texas, Trustee of the said Charles Schreiner Road
Fund, expend those funds now under its control which constitute the earnings
of the said trust fund for the ;year 1970 as well as prior years for the purpose
of aiding the Commissioners Court of Kerr County in the procurement of right-
of-way for the reconstruction of the portion of State Highway 16 as aforesaid;
And it is further recommended that the said Chas. Schreiner Bank make
payment of such accrued funds to the Kerr County Treasurer for deposit in the
Highway 16 Right-of-Way Fund within the Kerr Gounty Treasury Account, doing
so at such time as all current investment of these funds have reached their full
