Nowlin and Wife, Hazel Nowlin On this the 13th day of March, 1.972, came on to be reconsidered by the Court certain provisions of Order No. 11, 431 as entered by the Court on the 23rd day of September, 1971, as is of record in Volume N, Page 253 of the M_nutes of the Court, and it appearing to the Court that - certain subsequent commitments entered into by= the Court with other P _,; parties as a necessary incidence to right-of-way ,procurement for the re- _ - , • construction of F. M. Road 480 have served to diminish the possibility of • ~ closing as a public roadway those ,portions of existing F. M. Road 480 re- _, .. _ `.; ~, • - ~ ferred to in said Order No. 11, 431; r_.'; And it further appearing to the Court that the damages and sever- ance damages incurred by the said R. F3, Nowlin and wife, Hazel Nowlin, as a result of their donations to Kerr County of the new right-of-way re- ferred to in said Order No. 11, 431 is substantially greater than the parties to the said agreement at that time calculated, it is ordered on motio~~ by Commissioner .atone seconded by Commissioner Sa 1 ~ ~~ and unanimously approved by the Court that the last paragraph of the said Order No. 11, 431 as entered by the Court on the 23rd day of September, 1971, be amended to read that Kerr County will pay the said R. B. Nowlin and wife, Hassel Nowlin, or their heirs the sum of $6, 000. 00 as consideration in the event that the closing and reconvey- ance of the existing Right-of-Way of F. M. 480 as therein referred to is not accomplished by October 1,197b.
