On this the 10th day of April.. 1972, came on to be considered by the Court the applica-
.~ tion of Emmie NI. Muenker, County Clerk, for authority to appoint and deputize Dona
K].i.ngemann as Deputy County Clerk for Absentee Voting, and it appearing that the aaplica-
tion should be approved; therefore, upon motion made by Commissioner Bartel, seconded by
Commissioner Sallee, the Court unanimously approved that said officer be authorized to
deputize Dona Klingemann as Deputy County Clerk for Absentee Voting and that she be paid
on ar_ hourly basis, effective the date of her qualification.

On this the 10th day of April 1972, came on to be examined by the Court Certificates
of Cancellation, Certificate Nos. 20397, 20398 and 20399, presented to the Court by Juanita
Reeves, Tax Assessor-Collector of Kerr County, and it appearing to the Court that the
reasons set out in said Certificate for the cancellation of taxes are good and sufficient:
it is therefore ordered by the Court that the said certificates be granted and signed by
the County Judge.
Motion made by Commissioner Stone, seconded by Commissioner Bartel and unanimously
approved by the Court.

DISTRICT COURT OF KERR COUNTY
On this the 1.Oth day of April, 1972, came on to be heard and considered by the Court
the necessity of intervention in Cause No. 451 on the Civil Docket of the 198th District
"' Court of Kerr County, styled Sam Benbow, et ux, et als, vs. Richard F. Shaheen;
And it appearing to the Court that the Defendant in this cause, Richard F. Shaheen,
has caused two gates to be locked, which,~tes are situated on a portion of public roadway
crossing the Shaheen F,anch and that the said locked gates constitute an obstruction which

prevents the continued free and uninterrupted use by the public of a section of roadway
running from the proximity of the Sunset Cemetery westerly to the east line of the former
F. C. Basle property which marks the beginning point to four connecting public road ease-
menu executed in the year 1957, and which are of record in. Vol. 3, Page 226, Page 225,
Page 229 and Page 231 of the Easement Records of Kerr County;
And it appearing further to the Court that the public interests in this and similar
public roadways require protection from unauthorized obstructions erected by private
parties, it is ordered on motion by Commissioner Stone, seconded by Commissioner Sallee,
and unanimously approved by the Court that Kerr County employ the professional services of
Mr. Thomas W. Pollard of the Law Firm of Pollard and Pollard as Special Attorney for Kerr
County for the purpose of intervention in the aforesaid Cause No. 451 with the aim of
preserving and protecting the right of free and uninterrupted public usage of the portion
of the public roadway aforesaid through the Richard F. Shaheen Ranch and to seek such
remedies and relief as may be had in law and in equity by R:err County acting for and in
behalf of the public.
