ORDER AF PROVING CONTRACTUAL AGREEMENT WITH TEXAS HIGHWAY
COMMISSION FOR CONSTRUCTION OF EXTENSION OF FRONTAGE ROAD
AT INTERSECTION OF INTERSTATE HIGHWAY 10 AND STATE HIGHWAY ]f,
On this the 32'd day of December, 1974, came on to be
heard and considered by the Court the matter of approving a contractual
agreement with the Texas Highway Commission, which agreement has been
drawn for the purpose of implementing the provisions of State Highway
Commission Minute Order No. 69, 320 as previously accepted by the Court
for the purpose of providing for the construction of an extension of an existing
frontage road along Interstate Highway 10 to intersect with State Highway 16;
` and it appearing to the Court that the necessary local funds required for
payment towards the estimated construction costs have heretofore been deposited
with the County Treasurer of Kerr County in a special escrow fund, it is
ordered	on motion by	Commissioner	Stone	seconded	by Commissioner
Sallee	and	unanimously	approved	that Kerr County	hereby approves
the aforesaid contractual agreement with the State Highway Commission which
provides for the payment of the sum of $42, 100. 00 from local sources towards
the cost of construction of the said frontage road extension; and it is further
ordered that the Clerk and the Treasurer are hereby authorized to draw a
<toucher on the IH 10 Frontage Road Escrow Account in the amount of
$42, 100. 00 payable to: State Treasurer, Account of Trust Fund No. 927,
which voucher is to be delivered to the State Highway Commission along with the
executed copies of the aforesaid contractual agreement.

THIS AGREEMENT, made this 3rd day of December 1974, by
and between Kerr County, Texas, hereinafter coiled the "County", Party of
the First Part, acting by and through its Commissioners Court and the State
of Texas, hereinafter called the "State", Party of the Second Part, acting
by and through its State Highway Commission.
WHEREAS, the County desires the construction of an extension of a
frontage road within the limits from its present terminus to State Highway
No. 16 on Interstate Highway No. 10 and the State will, among other things,
provide for the construction of this work within these limits and the County
will contribute a fixed amount of Forty Two Thousand One Hundred and No/100
Dollars ($42,100.00), in payment for their portion of this work, and
WHEREAS, the County by the execution of this agreement agrees to the
terms and conditions of State Highway Commission Minute No. 69320, as it
applies to the County, a copy of which is attached hereto and marked "Exhi-
bit A" aad made a pert of this agreement.
NOW THEREFORE, it is understcod that this proposed work will be con-
atructed by the 9tats end the County will transmit to the State with the
return of this agreement, executed by the County, a warrant or check made
payable to the State Treasurer, Account of Trust Fund No. 927 in the amount
of Forty Two Thousand One Hundred and No/100 Dollars ($42,100.00). It ie
further understood that the State will construct only those items for the
County as requested and it ie further understood that the contribution of

WHEREAS, in KERB COUNTY on INTERSTATE HIGHWAY 10 near Kerrville,
local officials have requested extension of a Frontage Road from its
present terminus to State Highway 16, a distance of approximately 0.2
mile; and
WHEREAS, it has been determined that construction of the re-
quested frontage road would materially add to the traffic safety on
this facility; and
WHEREAS, it is the desire of the Texas Highway Department to
assist the County in such work;
NOW, THEREFORE, the State Highway Engineer is directed to tender
the following proposal to Kerr County:
Provided the County will:
1. Furnish ail necessary right of way free of cost and clear of
obstructions, with acquisition procedures in accordance with
applicable Federal and State laws governing the acquisition
policies for acquiring real property.
2. Provide for adjustment of utilities and for necessary reloca-
tion assistance payments involved in acquisition of right of
way.
3. Contribute the sum of 542,100.00 toward the construction cost
of the project.
The Texas Highway Department will provide for construction of
grading, structures and surfacing for a Frontage Road over the above
limits at an estimated State cost of b42,100,00, financing the cost in
the 1975 State Highway Safety and Betterment Program.
Upon acceptance of this Order by the appropr-isle officials of
Kerr County, the State Highway Engineer is directed to enter into neces-
sary agreements with the County covering the details of the proposed im-
provements, to proceed with engineering development of the project, and
with construction as authori2ed herein in the most feasible and economical
manner.
This Order is subject to acceptance by Kerr County and"if not
accepted within 90 days of the date hereof, the action herein contained
shall be automatically cancelled.

Minute Order pertains to the above referenced frontage road extension

visions of State Highway Commission Minute Order No. 69320. Please have '
your Commissioners' Court execute these resolutions and furnish this
office with two (2) certified copies in order that we may proceed with
the development of this project.
