NO. 12039 ORDER CONFIRMING USE OF AGRICULTURE EXHIBITION BUILDING BY THE KERR COUNTY LIVESTOCK ASSOCIATION FOR THE 1974 STOCK SHOW - JANUARY 13th THRU JANUARY 22, 1974 On this the 14th day of January 1974, upon motion made by Commissioner Stone, seconded by Commissioner Sallee, the Court unanimously approved the confirmation of the request for use of the Agriculture Exhibition Building and Grounds by the Kerr County Livestock Associa- tion for the 1974 Stock Show, January 13th thru January 22nd, 1974, at no charge, except clean-up. o-o-o-o-o-o-o-o-o-o NO. 12040 ORDER DIRECTING FUNDING OF PAYMENT FOR KERR COUNTY FLOOD CONTROL BONDS CALLED FOR RETIREMENT JANUARY 15, 1974 On this the 14th day of January, 1974 came on to be heard and considered by the Court the matter of directing the funding of payments for Kerr County Flood Control Bonds Nos. 90-134 inclusive called for redemption as of January 15, 1974 pursuant to Order No. 12001 entered on the 10th day of December, 1973; and it appearing to the Court that the sum of $45,000.00 will be required to comply with the provisions of the aforesaid order, it is ordered on motion by Commissioner Bartel, seconded by Commissioner Sallee and unanimously approved by the Court that the Clerk and the Treasurer be authorized to draw vouchers in the aggregate sums of $45,000.00 for the purpose of redeeming said Bonds Nos. 90-134 as follows: 1. After the payment of principal on regularly maturing bonds in the amount of $6,000.00 out of the present Flood Control Sinking Fund and after the payment of interest due on all outstanding bonds as of January 15, 1974 in the estimated amount of $777.75, vouchers shall be drawn towards the redemption of bonds Nos. 90-134 inclusive so as to reduce said Sinking Fund to a zero balance. 2. After reducing said Sinking Fund to a zero balance, vouchers to redeem the remainder of said bonds Nos. 90-134 in the principal amount of $45,000.00 shall be drawn on the Flood Control Maintenance Fund; and it is further ordered that the sum of $6,300.00 is hereby ordered temporarily transferred £rom the General Fund to the Flood Control Maintenance Fund j~(~ to cover any deficiencies of funds as might be required to accomplish the foregoing as of v'V~";) January 15, 1974, it being the intention of the Court that the General Fund of Kerr County shall subsequently be reimbursed from ad valorem tax collections hereafter deposited in the Flood Control Maintenance Fund. o-o-o-o-o-o-o-o-o-o NO. 12041 ORDER CLOSING OUT KERR COUNTY FLOOD CONTROL SINKING FUND On this the 14th day of January, 1974, came on to be heard and considered by the Court the matter of closing out the Flood Control Sinking Fund heretofore established by the Kerr County Treasurer for the purpose of the payment of interest and principal due on the Kerr County Flood Control Bonds, Series of 1956; and it appearing to the Court that pursuant to orders entered this date, all outstanding bonds of said series will be called and retired as of January 15, 1974 and that in so doing, the aforesaid Flood Control Sinking Fund will / be reduced to a zero balance and that thereafter there will no longer exist a need for said fund, it is ordered, on motion by Commissioner Sallee, seconded by Commissioner Schwethelm and unanimously approved by the Court that from and after the time the said Sinking Fund is reduced to a zero balance as aforesaid, it shall be finally closed out on the books of the Treasurer of Kerr County and no more ad valorem tax collections deposited therein; and it is further ordered that thereafter all Flood Control ad valorem taxes transmitted to the 't~~' Treasurer by the County Tax Collector be deposited in the Kerr County Flood Control Mainten- ance Fund, the foregoing procedure to apply to all remaining current ad valorem taxes as well as to all delinquent ad valorem taxes heretofore levied for flood control purposes. o-o-o-o-o-o-o-o-o-o NO. 12042 ORDER ACCEPTING OFFER OF MRS. ANNIE MAE WITT TO ACCEPT CASH COMPENSATION IN LIEU OF STOCKPASS FENCING ON F. M. 480 RIGHT OF WAY On this the 14th day of January, 1974, came on to be heard and considered by the Court the offer of Mrs. Annie Mae Witt to accept the sum o£ $200.00 cash consideration in lieu of the connecting stockpass fencing which Kerr County had obligated itself to construct pur- suant to the provisions of Order No. 11291 entered on the 8th day of February, 1971, and it appearing to the Court that the proposal would be reasonable and mutually advantageous to all parties, it is ordered on motion by Commissioner Sallee, seconded by Commissioner Schwethelm and unanimously approved by the Court that Kerr County hereby accepts the afore- said proposal and it is further ordered that the Clerk and the Treasurer be authorized to draw a voucher on the F. M. 480 right of way fund in the amount of $200.00 payable to Annie Mae Witt, which payment shall be deemed to be a full and final discharge of Kerr County's prior obligation to construct fencing to connect the ends of the aforesaid stockpass with the existing right of way fencing of F. M. Road 480. o-o-o-o-o-o-o-o-o-o NO. 12043 ORDER APPROVING RESOLUTION REQUESTING THE TEXAS HIGHWAY COMMISSION TO DECLARE CERTAIN UNUSED PORTIONS OF FARM TO MARKET ROAD 480 RIGHT OF WAY SURPLUS AND TO QUITCLAIM SAID PROPERTIES TO THE COUNTY OF KERR OF THE STATE OF TEXAS On this the 14th day of January 1974, upon motion made by Commissioner Schwethelm, seconded by Commissioner Sallee, the Court unanimously approved a Resolution requesting the Texas Highway Commission to declare certain unused portions of Farm to Market Road 480 Right- of-Way surplus and to quitclaim said properties to the County of Kerr of the State of Texas. RESOLUTION REQUESTING THE TEXAS HIGHWAY COMMISSION TO DECLARE CERTAIN UNUSED PORTIONS OF FARM TO MARKET ROAD 480 RIGHT OF WAY SURPLUS AND TO QUITCLAIM SAID PROPERTIES TO THE COUNTY OF KERR OF THE STATE OF TEXAS WHEREAS, right of way easements across certain tracts of land in the County of Kerr, State of Texas, were acquired by and in the name of the County of Kerr and subsequently used by the State of Texas in construction and maintenance of Farm to Market Road 480, said tracts being: Recording Data Acreage Original Grantors Date Volume/Page 1.43 J.
