Martinez, and it appearing to the Court that the roadway concerned was originally located on a right of way granted Kerr County by D. P. Braden in a deed recorded in Vol. 92, page 525, Kerr County Deed Records, but that a portion of said roadway has been relocated by mutual consent and public usage onto other portions of the parent tract of abutting land originally owned by D. P. Braden, thus leaving 0.173 acres of such originally granted roadway as an abandoned area no longer used as a public roadway and no longer required as such by Kerr County, and it further appearing to the Court that David Hough and wife, Mary Dell Hough, are the present successors in title to D. P. Braden as to all lands originally involved herein, it is ordered on motion by Commissioner Schwethelm, seconded by Commissioner Bartel, and unanimously approved by the Court that Kerr County execute a quitclaim deed as to 0.173 acres of land out of Survey 124, F. Martinez, occupied by the abandoned portions of the said original roadway to the said David Hough and wife, Mary Dell Hough, and it is further ordered that the County Judge be hereby authorized to execute and deliver the aforesaid quitclaim deed to the grantees. o-o-o-o-o-o-o-o-o-o NO. 12154 COMMISSIONERS' COURT TO MEET AS BOARD OF EQUALIZATION JULY 8th and 9th, 1974 On this the 10th day of June 1974, came on to be heard and considered by the Court the matter of the Commissioners' Court sitting as a Board of Equalization, and it appearing to the Court that the same is a necessity; therefore, on motion made by Commissioner Bartel, seconded by Commissioner Sallee, it was unanimously approved that the Commissioners' Court convene on Monday, July 8th, 1974 at 9:00 o'clock A. Schero upon the final filing for recordation of the right of way instruments concerned; and it further appearing to the Court that Joe E. Schero as lienholder has executed and delivered the partial releases of liens concerned and that the said Joe E. Schero has been paid in full by Kerr Country Land, Inc, and has further so acknowledged in a written state- ment wherein he authorized and directed the voucher in the amount of $33,129.00 referred to in said order No. 2115 to be made payable to Kerr Country Land, Inc. only, it is ordered on motion by Commissioner Stone, seconded by Commissioner Schwethelm and unanimously approved by the Court that Commissioners' Court Order No. 12,115 entered on May 2, 1974 be amended so as to provide that the Clerk and the Treasurer shall draw a voucher on the Highway 16 right of way fund in the amount of $33,129.00 payable to Kerr Country Land, Inc. for delivery as originally authorized. o-o-o-o-o-o-o-o-o-o NO. 12156 OFFER TO THOMAS C. SYFAN AND WIFE, META REAL SYFAN, FOR RIGHT OF WAY FOR STATE HIGHWAY 16 On this the 12th day of June, 1974, came on to be heard and considered by the Court the matter oŁ acquiring a parcel of land designated by the Texas Highway Department as Right of Way Parcel No. 19 from Thomas C. Syfan and wife, Meta Real Syfan, for the reconstruction of State Highway 16, and it appearing to the Court that, as a result of prior negotiations an agreed consideration for the conveyance of the said Parcel No. 19 has been arrived at, it is ordered on motion by Commissioner Stone, seconded by Commissioner Schwethelm and un- animously approved by the Court that Kerr County offers to pay Thomas C. Syfan and wife, Meta Real Syfan, the sum of $3165.39 as compensation for land and damages for their conveyance to the State of Texas of a parcel of land out of Lot No. 19 of Kerrville Hills Ranch Estates, comprising 0.868 acres out of Survey No. 147, N, Hoyt, with payment being made upon approval for filing and recordation by the Texas Highway Department of their properly executed right of way deed, together with a partial release of an outstanding lien by the First National Bank of Kerrville, which approval shall be conditioned on final title approval and payment of all ad valorem taxes, including current taxes heretofore assessed against the property conveyed, and it is further ordered that the Clerk and the Treasurer be authorized to draw a voucher on the Highway 16 right of way fund in the amount of $3,165.39 payable to Thomas C.
