On this the 19th day of August, 1974, came on to be heard and considered by the Court the matter of acquiring a parcel of land designated by the Texas Highway Department as Right of Way Parcel No. 1 from Richard Joseph Potter and wife, Sarah Potter, for the re- construction of State Highway 16, and it appearing to the Court that, as a result of prior negotiations an agreed consideration for the conveyance of the said Parcel No. 1 has been arrived at, it is ordered on motion by Commissioner Stone, seconded by Commissioner Schwethelm, and unanimously approved by the Court that Kerr County offers to pay Richard Joseph Potter and wife, Sarah Potter, the sum of $30,000.00 as compensation for land and damages for their conveyance to the State of Texas of a parcel of land, comprising 2.638 acres out of Survey No. 146, W. C. Francis, with payment being made upon approval for filing and recordation by the Texas Highway Department of their properly executed right of way deed, together with a partial release of an outstanding lien by the authorized successors in title of Mae Louise S. Carruth, Deceased, which approval shall be conditioned on final title approval and payment of all ad valorem taxes, including current taxes heretofore assessed against the property conveyed, and it is further ordered that the Clerk and the Treasurer be authorized to draw a voucher on the Highway 16 right of way fund in the amount of $30,000,00 payable to Richard Joseph Potter, Sarah Potter, and such person or fiduciary as may have signed the aforesaid partial release of lien, which voucher shall be delivered upon Final approval for filing and recordation by the Texas Highway Department of the right of way deed and partial release of lien as aforesaid, o-o-o-o-o-o-o-o-o-o COURT ADJOURNED AUGUST 19, 1974 at 4:05 o'clock P, M. o-o-o-o-o-o-o-o-o-o COURT CONVENED IN SPECIAL SESSION AUGUST 20, 1974 at 10:40 o'clock A. Logan and wife, Patricia Lynn Logan, for the reconstruc- tion of State Highway 16, and it appearing to the Court that, as a result of prior negotia- tions an agreed consideration for the conveyance of the said Parcel No. 26J has been arrived at, it is ordered on motion by Commissioner Bartel, seconded by Commissioner Schwethelm, and unanimously approved by the Court that Kerr County offers to pay Russell J. Logan and wife, Patricia Lynn Logan, the sum of $1,100.00 as compensation for land and damages for their conveyance to the State of Texas a parcel of land comprising 0.253 acres out of Survey No. 400, J. S. Lester, with payment being made upon approval for filing and recordation by the Texas Highway Department of their properly executed right of way deed, together with a partial release of outstanding liens by the First National Bank of Kerrville, and by the Chas. Schreiner Bank of Kerrville, Texas, which approval shall be conditioned on final title approval and payment of all ad valorem taxes, including current taxes heretofore assessed against the property conveyed, and it is further ordered that the Clerk and the Treasurer be authorized to draw a voucher on the Highway 16 right of way fund in the amount of $1,100.00 payable to Russell J. Logan, Patricia Lynn Logan, First National Bank of Kerrville, and Chas.
