NOW, THEREFOKE, the State highway Engineer is directed to tender the following proposal
to Kerr County:
Provided the County will:
1. Furnish all necessary right of way free of cost and clear of obstructions, with
acquisition procedures in accordance with applicable Federal and State laws governing the
acquisition policies for acquiring real property.
2. Provide for adjustment of utilities and for necessary Relocation Assistance payments
involved in acquisition of right of way.
3. Contribute the sum of $42,100 toward the construction cost of the project.
The Texas Highway Department will provide for construction of Grading, Structures and
Surfacing for a Frontage Road over the above limits at an estimated State cost of $42,100,
financing the cost in the 1975 State Flighway Safety and Betterment Program.
Upon acceptance of this Order by the appropriate officials of Kerr County, the State Highway
Engineer is directed to enter into necessary agreements with the County covering the details
of the proposed improvements, to proceed with engineering development of the project, and
with construction as authorized herein in the most feasible and economical manner.
This Order is subject to acceptance by Kerr County and if not accepted within 90 days of
the date hereof, the action herein contained shall be automatically cancelled.

NO. 12243 ORDER FOR PAYMENT TO ERVIN H. BOESSLING AND WIFE PATRICIA BOESSLING IN LIEU OF
FENCIIQG ALONG ROAD EASEP•IENT IN PRECINCT #4
On this the 14th day of October, 1974, came on to be heard and considered by the Court
the matter of complying with a portion of Kerr County's agreement of settlement in Cause No.
451 in the 19£3th District Court of Kerr County, styled Sam Benbow, et ux, et al vs. Richard
F. Shaheen, et ux, in which cause Kerr County was an intervening party, and it appearing
to the Court that pursuant to an agreement of settlement in said cause executed on April 15,
1974, Kerr County agreed pursuant to Item II(4) set forth on pages 4 and 5 of said settle-
ment agreement, to construct certain fencing along a portion of public road easement granted
by Ervin H. Boessling and wife, Patricia Boessling, doing so by December 31, 1974, and it
further appearing to the Court that Kerr County did, as a portion of said agreement of
settlement, reserve the option to pay the said Ervin H. Boessling and wife, Patricia Boessling,
the reasonable cost of constructing said fencing as an alternative to Kerr County's actually
constructing said fencing, and it further appearing to the Court that a bona fide
estimate for labor and materials for the construction of said fencing has been provided
I:err County by the said E. H. Boessling, which estimate is filed herewith as exhibit "A"

to this order, and which estimate is in the amount of $7,959.50, it is ordered on motion
by Commissioner Stone, seconded by Commissioner Sallee, and unanimously approved by the
Court, that Kerr County exercise its option to pay the said E. H. Boessling and Patricia
Boessling the amount of $7,959.50 in lieu of construction by Kerr County of the aforesaid
fencing along the aforesaid public road easement granted to Kerr County, and it is further
ordered that the Clerk and the Treasurer be authorized to draw a voucher on the General
Road and Bridge Fund of Kerr County in the amount of $7,959.50, payable to Ervin H. Boessling
and Patricia Boessling, in full and final settlement of Kerr County's fencing obligations
as per agreed settlement in Cause No. 451, 19IIth District Court.

DISTRIBUTION LINE ON A PORTION OF INGRAM LOOP ROAD RIGHT OF WAY IN THE TOWN
OF INGRAM
On this the 14th day of October 1974, came on to be heard and considered the request
of the Lower Colorado Fiver Authority for permission of record to be granted £or the said
agency of the State of Texas to construct an electric distribution line along and upon a ^
portion of public road right of way in the unincorporated town of Ingram, Texas known as
Ingram Loop; and it appearing to the Court that the construction of said electric distribu-
tion line would serve a necessary public purpose and would not interfere with the public
usage of said roadway, it is ordered on motion by Commissioner Sallee, seconded by Commis-
sioner Stone, and unanimously approved by the Court that Kerr County hereby grants the
Lower Colorado River authority permission to construct an electric distribution line along
a portion of public road right of way in the Town of Ingram known as Ingram Loop, commenc-
ing at the northwest end of said loop at State Highway 27 and running southeasterly to a
point approximately 400 feet north of the right of way of State Highway 39 and as is more
particularly shown on a map filed herewith as Exhibit "A" to this order and dated August
23, 1974, with the designation of "Ingram Feeder No. 1".

On this the 14th day of October 1974, came on to be considered by the Court the applica-

tion of Juanita Reeves Maples, Tax Assessor-Collector of Kerr County, Texas, for authority
to appoint and deputize Gertrude Lorene Key as Deputy Tax Assessor-Collector of Kerr County,
Texas and it appearing to the Court that said application should be approved; therefore,
upon motion made by Commissioner Bartel, seconded by Commissioner Sallee, the Court unani-
mously approved that said officer be authorized to deputize Gertrude Lorene Key as Deputy
Tax Assessor-Collector of F:err County, Texas, at a salary of $5100.00 per annum, effective
the date of her qualification, the same being October 15, 1974, payable out of Revenue
Sharing Trust Fund,
