NOW, THEREFOKE, the State highway Engineer is directed to tender the following proposal to Kerr County: Provided the County will: 1. Furnish all necessary right of way free of cost and clear of obstructions, with acquisition procedures in accordance with applicable Federal and State laws governing the acquisition policies for acquiring real property. 2. Provide for adjustment of utilities and for necessary Relocation Assistance payments involved in acquisition of right of way. 3. Contribute the sum of $42,100 toward the construction cost of the project. The Texas Highway Department will provide for construction of Grading, Structures and Surfacing for a Frontage Road over the above limits at an estimated State cost of $42,100, financing the cost in the 1975 State Flighway Safety and Betterment Program. Upon acceptance of this Order by the appropriate officials of Kerr County, the State Highway Engineer is directed to enter into necessary agreements with the County covering the details of the proposed improvements, to proceed with engineering development of the project, and with construction as authorized herein in the most feasible and economical manner. This Order is subject to acceptance by Kerr County and if not accepted within 90 days of the date hereof, the action herein contained shall be automatically cancelled. Shaheen, et ux, in which cause Kerr County was an intervening party, and it appearing to the Court that pursuant to an agreement of settlement in said cause executed on April 15, 1974, Kerr County agreed pursuant to Item II(4) set forth on pages 4 and 5 of said settle- ment agreement, to construct certain fencing along a portion of public road easement granted by Ervin H. Boessling and wife, Patricia Boessling, doing so by December 31, 1974, and it further appearing to the Court that Kerr County did, as a portion of said agreement of settlement, reserve the option to pay the said Ervin H. Boessling and wife, Patricia Boessling, the reasonable cost of constructing said fencing as an alternative to Kerr County's actually constructing said fencing, and it further appearing to the Court that a bona fide estimate for labor and materials for the construction of said fencing has been provided I:err County by the said E.
