Schwethelm Commissioner Precinct No. 1 Roger Stone Commissioner Precinct No. 4 and the Court having duly opened, the following proceedings were had: NO. 12272 ORDER AMENDING ORDER NO, 12,209 OFFER TO RICHARD JOSEPH POTTER AND WIFfi SARAH POTTER FOR RIGHT OF WAY FOR STATE HIGHWAY 16 On this the 22nd day of November, 1974, came on to be heard and considered by the Court the mmatter of ammendinq a portion of Order No. 12,209 entered on August 19, 1974 and record- ed in Vol. N, page 533 of the minutes of the Commiasionera~ Court; and it appearing to the Court that the said order no. 12,209 provided for the issuance of a voucher by the Clerk and the Treasurer in the amount of S30,000.00 payable to Richard Joseph Potter, Sarah Potter, and such person or fiduciary as might sign a certain partial release of lien as successor in title to Mae Louise S, Carsuth, Deceased, upon the final filing for recordation of the right of way instruments concerned; and it further appearing to the Court that the lienholder representative, Chas. Schreiner Bank of Kerrville, Texas, Trustee, executed and delivered the partial Y,elease of lign concerned and has advised by letter that the said successor and representative of the deceased lienholder does not desire to participate in the consideration to be paid for the conveyance for the parcel of right of way as referred to in said order No. 12,209, it is ordered on motion by Commissioner Schwethelm, seconded by Commissioner Stone, and unanimously approved by the Court that Commisaioners~ Court Order No. 12,209 entered on August 19, 1974 be amended so as to provide that the Clerk and the Treasurer shall draw a voucher on the Highway 16 right of way fund in the amount of $30,000.00 payable to Richard Joseph Potter and wife, Sarah Potter for delivery as originally authorized. o-o-o-o-o-o-o-o-o-o COURT ADJOURNED NOVEMBER 22, 1974 at 10:30 o~clock A.
