h ;~ ~~ NO. 12278 ADOPTION OF RESOLUTION FOR APPLICATION AUTHORIZING PARTICIPATION IN RATIONAL FLOOD INSURANCE PROGRAM On this the 9th day of December 1974, upon motion made by Commissioner Baztel, seconded by Commissioner Sallee, the Court unanimously approved the adoption of a Resolution for application authorizing participation in the National Flood Insurance Program. A RESOLUTION BY THE COMMISSIONERS COURT OF KERB COUNTY, TEXAS, authorizing the filing of an application for pazticipatigm in the National Flood Insurance Program. WHEREAS, certain areas of Kerr County are subject to periodic flooding from the Guadalupe River and its tributaries, causing serious damages to properties within these areas; and WHEREAS, relief is available in the form of Federally subsidized flood insurance as authorized by the National Flood Insurance Act of 1968; and WHEREAS, it is the intent of the Commissioners Court of Kerr County to require the recognition and evaluation of flood hazards in all official actions relating to land use in the flood plain areas having special flood hazards; and WHEREAS, this body has the legal authority to adopt land use and control measures to reduce future flood losses pursuant to State of Texas, Article 8280-13, V.A.T.S.; NOW, THEREFORE, BS IT RESOLVED, that the Commissioners Court of Kerr County, Texas, hereby: 1. Assures the Federal Insurance Administration that it will enact as necessary, and maintain in force for those areas having flood or mudslide hazards, adequate land use and control aeasures with effective enforcement provisions consistent with the Criteria set forth in Section 1910 of the National Flood Insurance Program Regulations; and 2. Vesta the Kerr County Commissioners Court with the responsibility, authority, and means to: a. Delineate or assist the Administrator, at his request, in delineating the limits of the areas having special flood hazards on available local maps of sufficient scale ~-- to identify the location of building sites. b. Provide such information as the Administrator may request concerning present uses and occupancy of the flood plain. c. Cooperate with Federal, State, and local agencies and private firms which undertake to study, survey, map, and identify flood plain or mudslide areas, and cooperate with neighboring communities with respect to management of adjoining flood plain and/or mudslide areas in order to prevent aggravation of existing hazards. d. Submit on the anniversary date of the community's initial eligibility on annual report to the Administrator on the progress made during the past year within the community in the development and implementation of flood plain management measures. 3. Appoints the Office of the Kerr County Commissioners Court to maintain for public inspection and to furnish upon request a record of elevations (in relation to mean sea level) of the lowest floor (including basement) of all new or substantially improved structures located in the special flood hazard azeas. If the lowest floor is below grade on one or more sides, the elevation of the floor immediately above must also be recorded. 4. WHEREAS, on the 9th day of December, A. D., 1974, this Court resolved to adopt and maintain in force for flood prone areas of Kerr County, Texas, measures with effective enforcement provisions consistent with Section 1910.3 of the National Flood Insurance Program as authorized by Article 8280-13 V.A.C.S.; and WHEREAS, this Court has found that enactment of the floodplain management measures herein set forth will matesially assist in minimizing damage to property and danger to life caused by periodic flooding of the Guadalupe River and its tributaries; IT IS THEREFORE ORDERED BY THE COMMISSIONERS COURT OF KERB COUNTY, TEXAS: SECTION 1. DEFINITIONS. The following definitions shall apply to the following terms found in this Order: A. FLOODPLAIN OR FLOOD PRONE AREA shall mean any land area within the County, adjoin- ing a river, stream, lake, or other watercourse which can reasonably be expected to be subject to periodic flooding, and which has been or subsequently may hereafter be identified as such by the Federal Insurance Administration pursuant to National Flood Insurance Regula- tions. 8. 100 YEAR FLOOD shall mean a flood of such magnitude as may reasonably be expected to be equalled or exceeded on an average of once every 100 years. C. FLOOD OR FLOODING shall mesa a general and temporary condition of partial or complete inundation of normally dry land areas from the overflow of streams sad other in- land waters. D. FLOODPLAIN AREA HAVING SPECIAL FLOOD HAZARDS means the maximum area of the flood- plain likely to ,be inundated by the 100 year flood (i.e., that has a one percent(l~) change of being flooded each year). E. FLOOD PROOFING means any combination of structural and nonstructural additions, changes, or adjustments to properties and structures which reduce or eliminate flood damage to lands, water and sanitary facilities, structures, and contents of buildings. F. FLOODWAY means the channel of a river or other watercourse and the adjacent land areas required to carry and discharge a flood of a given magnitude. G. START OF CONSTRUCTION NEW CONSTRUCTION OR CONSTRUCTION means the first place- meat of permanent construction on a site such as the pouring of slabs or footings, or any work beyond the stage of excavation. For a structure without a basement or poured footings, the start of construction includes the first permanent framing or assembly of the struc- ture or affixing of any prefabricated structure or .mobile home to its permanent site.
