Sallee Commissioner Precinct No. 2 and the Court having duly opened, the following proceedings were had: NO. 12283 ORDER AUTHORIZING PAYMENT TO LOWER COLORADO RIVER AUTHORITY FOR ESTIMATED NET COST OF UTILITY RELOCATION FOR IH10 FRONTAGE ROAD EYTEDiSION On this the 11th day of December 1974 came on to be heard and considered by the Court the matter of payment to the Lower Colorado River Authority of the estimated cost for the relocation of their lines for the purpose of the extension of the IH10 Frontage Road to connect with State Highway 16; and it appearing to the Court that the Texas Highway Depart- ment is prepared to proceed with the construction of said roadway it is ordered on motion by Commissioner Sallee, seconded by Commissioner Schwethelm and unanimously approved by the Court that Kerr County hereby accepts the proposal of the Lower Colorado River Authority to undertake the necessary utility relocation for an estimated cost of $2,715.22, and agrees to make payment of the amount of the estimated costs; and it is further ordered that the Clerk and the Treasurer be authorized to draw a voucher on the IH10 Frontage Road Escrow Account in the amount of S2, 715.22 payable to Lower Colorado River Authority. o-o-o-o-o-o-o-o-o-o COURT DECEMBER 11, 1974 at 10:00 o~clock A. M. o-o-o-o-o-o-o-o-o-o ORDER NO. 12273 M 142-14-18 Kerr County STATE OF TS7CAS I COUNTY OF TRAVIS ] THIS AGREEMENT, made this 3rd day of December 1974, by and between Kerr County, Texas, hereinafter called the "County", Party of the First Part, acting by and through its Commis- sionezs Court and the State of Texas, hereinafter called the "State", Party of the Second Part, acting by and through its State Highway Commission. WHEREAS, the County desires the construction of an extension of a frontage road within the limits from its present terminus to State Highway No. 16 on Interstate Highway No. 10 and the State will, among other things, provide for the construction of this work within these limits and the County will contribute a fixed amount of Forty Two Thousand One Hundred and No/100 Dollars(S42,100.00), in payment for their portion of this work, and WHEREAS, the County by the execution of this agreement agrees to the terms and condi- tions of State Highway Commission Minute No. 69320, as it applies to the County, a copy of which is attached hereto and marked "Exhibit A" and made a part of this agreement. NOW THEREFORE, it is understood that this proposed work will be constructed by the State and the County will transmit to the State with the return of this agreement, executed by the County, a warrant or check made payable to the State Treasurer, Account of Trust Fund No. 927 in the amount of Forty Two Thousand One Hundred and No/100 Dollars ($42,100.00). It is further understood that the State will construct only those items for the County as requested and it is further understood that the contribution of Forty Two Thousand One Hundred and No/100 Dollars (542,100.00), by the County shall be a fixed amount for their share of the work. It is further understood that the County by the execution of this agreement agrees to the terms and conditions of State Highway Commission Minute No. 69320, as it applies to the County, a copy of which is attached hereto and marked "Exhibit A" and made a part of this agreement. Brooks (State) Director, Finance WHEREAS, in KERB COUNTY on INTERSTATE HIGHWAY 10 near Kerrville, local officials have requested extension of a Frontage Road from its present terminus to State Highway 16, a distance of approximately 0.2 mile; and WHEREAS, it has been determined that construction of the requested frontage road would materially add to the traffic safety on this facility; and WHEREAS, it is the desire of the Texas Highway Department to assist the County in such work; NOW, THEREFORE, the State Highway Engineer is directed to tender the following proposal to Kerr County: Provided the County will: 1. Furnish all necessary right of way free of cost and clear of obstructions, with acquisition procedures in accordance with applicable Federal and State laws governing the acquisition policies for acquiring real property. 2. Provide for adjustment of utilities sad for necessary relocation assistance pay- manta involved in acquisition of right of way. 3. Contribute the sum of S42,100.00 toward the construction cost of the project. The Texas Highway Department will provide for construction of grading, structures and surfacing for a Frontage Road over the above limits at an estimated State coat of $42,100.00, financing the cost in the 1975 State Highway Safety and Betterment Program. IIpon acceptance of this Order by the appropriate officials of Kerr County, the State Highway Engineer is directed to enter into necessary agreements with the County covering the details of the proposed improvements, to proceed with engineering development of the project, and with construction as authorized herein in the most feasible and economical manner. This Order is subject to acceptance by Kerr County and if not accepted within 90 days of the date hereof, the action herein contained shall be automatically cancelled.
