ORDER NO. 12110 ORDER ACCEPTING AGREEMENT OF SETTLEMENT AND APPROVING AGREED JUDGMENT AS TO MATTERS IN CONTROVERSY IN CAUSE NO. 451 PENDING IN THE 198TH DISTRICT COURT OF KERR COUNTY STYLED SAM BENBOW, ET UX, ET ALS, VS. RICHARD F. SHAHEEN, ET UX. On this the 15th day of Apri 1, 1974, came on to be heard and considered by the Court, convened at a Special Term and acting in accord with a public notice posted more than 72 hours prior to this date, the proposed Agreement of Settlement between Shaheen and Kerr County and the proposed Agreed Judgment to be entered in Cause No. 451 pending in the 198th District Court of Kerr County styled Sam Benbow, et ux, et als vs. Richard F. Shaheen, et ux and in which cause Kerr County is an intervening party plaintiff; and after due consideration by the Court and upon recommendation of legal counsel for Kerr County it is ordered on motion by Commissioner Stone seconded by Commissioner Sallee and unanimously approved by the Court that Kerr County does hereby agree to approve and enter into the aforesaid "Agreement of Settlement", a copy of which is filed herewith with the Clerk of the Court as "Exhibit A"; and fu rther that Kerr County approve the aforesaid "Agreed Judgment", a copy of which is filed herewith with the Clerk of the Court as "Exhibit B", with Kerr County`s approval of each instrument to be evidenced by the signatures of each member of the Commissioners' Court of Kerr County; and it is further ordered that Kerr County agrees to accept all easements referred to in the aforesaid Agreement of Settlement and Agreed Judgment and upon the concurrence of all parties and the entry of final judgment in the said Cause No. 451 to proceed with the performance of all matters therein contained, including the payment of such sums of money as may be therein provided.
