ORDER NO. 12043 RESOLUTION REQUESTING THE TEXAS HIGHWAY COMMISSION TO DECLARE CERTAIN UNUSED PORTIONS OF FARM TO MARKET ROAD 480 RIGHT OF WAY SURPLUS AND TO QUITCLAIM SAID PROPERTIES TO THE COUNTY OF KERR OF THE STATE OF TEXAS WHEREAS, right of way easements across certain tracts of land in the County of Kerr, State of Texas, were acquired by and in the name of the County of Kerr and subsequently used by the State of Texas in construction and maintenance of farm to Market Road 480, said tracts being: Recording Data A Original ,ran ors Date Volume/Page 1.43 J. Lane 7/10/36 59/523 2.62 Jesse Vallier, f.s. 7/10/36 59/524 4.1 Henry Wellborn, et ux 6/23/36 59/526 Helen Wellborn WHEREAS, due to the reconstruction and relocation of said Farm to Market Road 480 certain sections of said facility were canceled by Texas Highway Com- mission Minute Order No. 68266 dated December 10, 1973, including portions of the aforesaid tracts; and WHEREAS, certain portions of the aforesaid tracts are no longer needed for the use of citizens as a road; IT IS, THEREFORE, REQUESTED by the Commissioners' Court of Kerr County, Texas, at its regular meeting that the Texas Highway Commission pass an appro- priate Minute Order declaring those certain portions, being three in number and more particularly described by metes and bounds in Exhibits "A" through "C" attached hereto, to be surplus right of way and in addition requesting the Governor of the State of Texas to execute a deed to the County of Kerr quitclaiming all right, title, and interest in and to said three surplus tracts of land by and on behalf of the State of Texas in accordance with the statutory and procedural requirements for the disposal of surplus right of way. ~ PASSED AND APPROVED this ~~ day of ~ -r~~~ /1/~-1 1974.
