On this the '~j" ORDER NO. '`~ day of ATwc-!^ib~^r A.D. 1974, at a regular meeting of the Commissioners Court of Kerr County, Texas, with a quorum present, came on to be considered by the Commissioners Court of Kerr County, Texas, at a regular term of such Court, the matter of the Application and Petition Łor Discontinuance of County Road heretofore filed by Willard O. Bass and wife, Jane L. Bass, and Willard R. Bass, pursuant to the provisions of Art. 6705, V.T.C.S., to discontinue the public road more fully hereinafter described, and the Commissioners Court, after having considered and fully discussed and understood such matter, finds as a fact or facts that such application and petition is signed by at least eight (8) freeholders in the precinct in which the hereinafter mentioned road is located; that the public road petitioned to be discontinued is fully described in such application and petition, including specifically a description of the beginning and termination of such road; that th.e applicants have given notice by written advertisement of their intended application and petition; that such written notice was posted at the courthouse door of the County Courthouse of Kerr County, Texas, Kerrville, Texas, and at two other public places in the vicinity~of the route of such road, the same being at the beginning and termination of_ such road; that such written notice was posted at said places more than at least twenty (20) days prior to the date of the granting of this order; that such public road has never been improved nor maintained by the County of Kerr except with the owners' permission nor has it ever been opened or used by the public except with the owners' permission and has never been dedicated to the public by the owners and that there is no public necessity that such road ever be or used as a public road; that the hereinafter described road should be closed and discontinued; that all prerequisites of law, whether mentioned specifically herein or not, have been duly and timely complied with and that the following order should be entered. - 1 it is, therefore, ORDERED that the following described public road be discontinued and closed, such road being more fully described as follows, to-wit: All that certain tract or parcel of land lying and being situated in the County of Kerr, State of Texas, and being more particularly described as follows, to-wit: BEGINNING at the southeast corner of a 9.8674 acre tract oŁ Land conveyed to Willard R. Bass by W. O. Bass, et ux, and recorded in Volume 150, Page 36, Deed Records, Kerr County, Texas, said southeast corner having geographical coordinates of - Latitude 30° 03' 10" north. and longitude 99° 24' 39" west, and from said southeast corner the northeast corner of original Survey 1854, Wiley Frasier, AB 1267 bears approximately west 1330 feet and south 280 feet; THENCE with the meanders of the existing road in a southerly direction through. the approximate center of said Bass Ranch (also known as all that certain tract or parcel of land, lying and being situated in the County of Kerr, State of Texas, and being more particularly described by metes and bounds in that certain deed dated February 6, 1959, from Virgie Wagner, et vir, to 4dillard 0. Bass, recorded in Volume 104, Page 264, Deed Records of Kerr County, Texas), as shown on the U. S. Geological Survey Quadrangle "Bee Caves Creek" 1964 1:24000' (1" _ 2000'), through original Surveys 1896, 1566 and 1726 to the termination point of said road at the south property line and fence line of the said Bass Ranch ( also known as all that certain tract or parcel of land, lying and being situated in the County of Kerr, State of Texas, and being more particularly described by metes and bounds in that certain deed dated February 6, 1959, from Virgie Wagner, et vir, to Willard 0. Bass, recorded in Volume 104, Page 264, Deed Records of Kerr County, Texas) at geographical coordinates of Latitude 30° O1' 21" north. and longitude 99° 24' 30°' west at a point 152.0 .feet west of the southeast corner of th.e said Bass Ranch (also known as all that certain tract or parcel of land lying and being situated in the County of Kerr, State of Texas, and being more particularly described by metes and bounds in that certain deed dated February 6, 1959, from Virgie Wagner, et vir, to Willard 0. Bass, recorded in Volume 104, Page 264, Deed Records of Kerr County, Texas), and from said southeast corner, the southeast corner of original Survey 1726, G.C.& S.F.R.R. AB 1743, bears east 766.7 feet. Surveyed on the ground and field notes written by Baron B. Floyd, Registered Public Surveyor No. 1408, August 26-29, 1974. - 2 - The Commissioners Court of Kerr County, Texas, further finds that Willard O. Bass and wife, Jane L. Bass, and Willard R. Bass, are the owners of the property on both sides of the above described land and that such above described land which adjoins their land should be conveyed to them. It is, therefore, ORDERED that the County Judge of Kerr County, Texas, Julius R. Neunhoffer, be and he is hereby authorized and empowered to execute and deliver to Willard O. Bass and wife, Jane L. Bass, and Willard R. Bass, all the right, title and interest and estate of Kerr County, Texas, in and to the above described property.
