ORDER NO. 12256 ORDER CLARIFYING ORDER NO. 12087 CONCERNING PROPOSED METHOD OF FUNDING KERR COUNTY SHARE OF CONSTRUCTION COSTS OF PROPOSED KERR COUNTY/CITY JAIL On this the 22nd day of October, 1974, came on to be heard and considered by the Court the matter of clarifying Order No. 12087 entered by the Court on the 21st day of March., 1974 and recorded in Volume N, Page 489 of the minutes of the Court; and it appearing to the Court that due to the passage of time which has elapsed since the entry of said Order No. 12087 which was entered for the purpose of complying with the requirements of a then pending grant application fora "Phase II" grant for funds for the preperation of actual construction plans for the proposed Kerr County-City jail facility, and that said grant application remains pending and is now being finally submitted to the Texas Criminal Justice Council; and it additionally appearing to the Court that there exists an absolute necessity to continue with and carry forward to final completion the plans for and the construction of the proposed new jail facility; and it further appearing to the Court that the City of Kerrville and Kerr County intend to apply for a subsequent grant for "Phase III" to assist in the actual construction cost of the aforesaid jail facility and that the Texas Criminal Justice Council has requested further clarification as to the source and amount of Kerr County's funding of its share of actual construction costs, it is ordered on motion by Commissioner Stone seconded by Commissioner Schwethelm and unanimously approved by the Court that the aforesaid Order No. 12087 entered on the 21st day of March, 1974 be further clarified by the herein set forth declaration that it remains Kerr County's fullest intention to proceed with the actual con struction of the proposed jail facility following the completion and approval of final construction plans and that it is Kerr County's present intention to use funds to provide Kerr County's one-half of the required one-third or more local money for actual construction costs from funds currently on deposit in Kerr County's General and Permanent Improvement Funds, anticipated additional ad valorem tax levies, and such other funds as may become available. -~~ 12~E~ E}Z I30.
