ORDER NO. 12120 OFFER TO ELAINE WERLEIN TERRELL AND HUSBAND, THOMAS 5. TERRELL FOR RIGHT OF WAY FOR STATE HIGHWAY 16 On this the 7th day of May, 1974, came on to be heard and considered by the Court the matter of acquiring a parcel of land designated by the Texas Highway Department as Right of Way Parcel No. 9 from Elaine Werlein Terrell and husband, Thomas S. Terrell, for the reconstruction of State Highway 16, and it appearing to the Court that, as a result of prior negotiations between the prior corporate owners and the present } owners and Kerr County an agreed consideration for the conveyance of the said Parcel No. 9 has been arrived at, it is ordered on motion by Commissioner Stone, seconiied by Commissioner Bartel and unanimously approved by the Court that Kerr County offers to pay Elaine Werlein Terrell, as her seperate property and estate, the sum of $2,254.90 as compensation for land and damages for her conveyance to the State of Texas of a parcel of land out of Lot No. 6 of Kerrville Hills Ranch Estates, comprising 0.692 acres out of Survey No. 147, N. Hoyt, with payment being made upon approval for filing and recordation by the Texas Highway Department of the owners' properly executed right of way deed, which approval shall be conditioned on final title approval and payment of all ad valorem taxes, including current taxes heretofore assessed against the property conveyed, and it is further ordered that the Clerk and the Treasurer be authorized to draw a voucher on the Highway 16 right of way fund in the amount of $2, 254. 90 payable to Elaine Werlein Terrell, which voucher shall be 3eliv~r~d to ttre owner upon final a.ppraual #ar filing and recordation by the Texas Highway Department of the right of way deed as aforesaid.
