ORDER NO. _12209 OFFER TO RICHARD JOSEFH FOTTER AND WIFE, SARAH POTTER, FOR RIGHT OF WAY FOR STATE HIGHWAY 16 On this the 19th day of August, 1974, came on to be heard and considered by the Court the matter of acquiring a parcel of land designated by the Texas Highway Department as Right of Way Parcel No. 1 from Richard Joseph Fotter and wife, Sarah Potter, for the reconstruction of State Highway ,.{ `~ ` . =~16, and it appearing to the Court that, as a result of prior negotiations an ~; ; ., ~; greed consideration for the conveyance of the said Parcel No. 1 has been ''' `'arrived at, it is ordered on motion by Commissioner Stone , ,- ~^ ,~ D,7 ~ `" ':;seconded by Commissioner SChwethelm and unanimously approved ~. ~~ ,by the Court that Kerr County offers to pay Richard Joseph Potter and wife, n ~: u;5arah Fotter, the sum of $30, 000. 00 as compensation for land and damages ,~ for their conveyance to the State of Texas of a parcel of land, comprising 2.638 acres out of Survey No. 146, W. C. Francis, with payment being made upon approval for filing and recordation by the Texas Highway Department of their properly executed right of way deed, together with a partial release of an outstanding lien by the authorized successors in title of Mae Louise S. Carruth, Deceased, which approval shall be conditioned on final title approval and payment of all ad valorem taxes, including current taxes heretofore assessed against the property conveyed, and it is further ordered that the Clerk and the Treasurer be authorized to draw a voucher on the Highway 16 right of way fund in the amount of $30,000.00 payable to Richard Joseph Potter, Sarah Potter, and such persom or fiduciary as may have signed the aforesaid partial release of lien, which voucher shall be delivered upon final approval for filing and recordation by the Texas Highway Department of the right of way deed and partial release of lien as aforesaid.
