OFFICE OF JUSTICE OF THE PEACE PRECINCT No. 1 K ERR COUNTY COURTHOUSE KERR VILLE, TEXAS 78028 March 4, 1975 SUBJECT: Monthly Collection Reports T0: Commissioners Court 512 - 257-7467 For many years Justices have been filing their monthly collection reports and showing thereon a disbursement on behalf of the County Attorney and the Sheriff. At the re- quest of Judge Neunhoffer I researched the law on this prob- lem and submitted my findings to him and to the Court, It is my opinion that neither the County Attorney nor the Sheriff are presently entitled to any commissions since they are now salaried officials, All fines and court costs other than the `2,50 cost in misdemeanor cases for the bene- fit of the Judicial Planning Council are deposited to the Officers Salary Fund from which all officers are paid. The computation of these commissions places additional work on the justices and the County Treasurer which is not really required under the present law. The only advantage to such procedure would be that of showing whether or not , any one department is is self sustaining; were the depart- ment still operating under the old laws pertaining to comet- :.'. fissions. ~.- ~ i ~:, :.
