Muenker Clerk of County Court Kerr County, Texas o-o-o-o-o-o-o-o-o-o NO. 12542 ORDER ESTABLISHING REQUIREMENT FOR DELIDTEATING 100 YEAR FLOOD LEVEL ON CERTAIN PLATS SUBMITTED TO THE COMMISSIONERS' COURT FOR APPROVAL PRIOR TO FILING FOR RECORD On this the 8th day of December, 1975 came on to be heard and considered by the Court the matter of requiring the delineation of the 100 year flood level on certain plats hereafter submitted to the Commissioners' Court of Kerr County for approval for filing in the Plat Records of Kerr County; and it appearing to the Court that proposed flood insurance require- ments and private sewage disposal permits within the 100 year flood plain have created a public necessity to have the 100 year flood level, where applicable, depicted on subdivision and other land plats submitted for filing in the Kerr County Plat Records in those instances where the platted lands abut the Guadalupe River and its major tributaries as well as other streams capable of generating a material flooding of land surface areas, it is ordered on motion by Commissioner Stone, seconded by Commissioner Bartel, and unanimously approved by the Court JJ1""" that hereafter all proposed plats of subdivisions and other lands which are submitted to the Commissioners' Court of Kerr County for approval for filing in the Kerr County Plat Records shall comply with the provisions of this order which are as follows: 1. The contour line of the 100 year frequency flood level shall, if the provisions of this order apply, be depicted on the proposed plat from the best available evidence pending its official determination, if any, by an agency of the United States or the Upper Guadalupe River Authority, and in the event of a prior determination by one of the aforesaid agencies, such determination shall prevail. Pending formal determination, the July, 1932 flood level shall be deemed to control as to lands abutting or lying adjacent to the Guadalupe River, the North and South Forks of the Guadalupe, and Johnson Creek. 2.
