NO. 12405 ORDER DIRECTING DISBURSEMENT OF UDTCLAIMED FUNDS DEPOSITED IN KERR COUNTY GENERAL FUND PURSUANT TO ORDER NO. 12,228 On this the 12th day of May, 1975, came on to be heard and considered by the Court the claim of Mrs. Neoma King of Nueces County, Texas, sole devisee of the Estate of Alfred E. Babbitt, Deceased, for reimbursement of the sum of S750.00 deposited in the General Fund of Kerr County by Robert I. Wilson, former Justice of the Peace of Precinct No. 1, successor custodian of the funds of former Justice of the Peace Raymond Orr, pursuant to the provisions of Order No. 12,288 entered by the Court on December 30, 1974 and recorded in Vol. N, Paqe 577 of the minutes of the Couzt; and it appeazing to the Court that, pursuant to documentary evidence submitted by former legal counsel of Alfred Enoch Babbitt, deceased, that the said Mrs. Neoma King of Nueces County, Texas, is the sole person entitled to receive the remain- ing assets of Alfred E. Babbitt, deceased, the original owner of the unclaimed $750.00 cash bond heretofore deposited in the General Fund of Kerr County as aforesaid; and it further appearing to the Court that the Commissioners' Court of Kerr County did, when authorizing the payment into the County Treasury of the said unclaimed funds, agree to repay such funds to the lawful claimant thereof in the event of proper claim; it is ordered on motion by Commissioner Bartel, seconded by Commissioner Sallee and unanimously approved by the Court that Kerr County accept the claim of the said Mrs. Neoma King; and it is further ordered that the Clerk and the Treasurer draw a voucher on the General Fund in the amount of $750.00 in refund of the unclaimed Cash bond of Alfred Enoch Babbitt, deceased; and that said voucher be made payable to James E. Nuqent, Attorney at Law, as per written authorization of Mrs. Neoma King filed herewith in the gagers of the Court. A-3, 1975-1976 On this the 12th day of May, 1975, upon motion made by Commissioner Stone, seconded by Commissioner Schwethelm, with Commissioners Schwethelm, Sallee, Bartel and Stone voting "Aye" and County Judge Neunhoffer voting "No", said motion carrying by a majority vote, it is ordered that the Statewide Hunting, Fishing and Trapping Proclamation No. A-3, 1975-1976 _. be disapproved in its entirety; it is further ordered that in event House Bill #1893 of the 64th Legislature has been or is enacted into law and is applicable, the taking of the wildlife resources of the County be governed by the General Law of the State of Texas, as authorized by House Bill #1893. o-o-o-o-o-o-o-o-o-o NO. 12407 APPROVING AND ADOPTING AN EMERGENCY OPERATIONS PLAN FOR THE COUNTY OF KERR whereas, an Emergency Operations Plan for the County of Kerr has been prepared by the County's Civil Defense Office and County department heads, and its approval and adoption by the County Commissioners Court is recommended; NOW THEREFORE: BE IT ORDAINED BY THE COUNTY COMMISSIONERS OF THE COUNTY OF KERR SECTION 1: That the Basic Emergency Operations Plan for the County of Kerr is hereby approved for use by all county departments, agencies, and employees. SECTION 2: A copy of the above described plan dated May 12, 1975 is attached hereto and incorporated herein by reference. Muenker County Clerk (Seal) o-o-o-o-o-o-o-o-o=o NO. 12408 ORDER BY THE COUNTY OF KERB, TEXAS, DESCRIBING THE FUNCTIONS, DUTIES, AND POWERS OF SHELTER MANAGERS DURING NATIONAL EMERGENCIES AND PROVIDING A PENALTY. BE IT ORDERED BY THE COMMISSIONERS' COURT OF THE COUNTY OF KERB, TEXAS: Section 1. In case of national emergency, Public Shelter Managers duly appointed by the Civil Defense Director, shall open public shelters, take charge of all stocks of food, water, and other supplies stored in said shelter, admit the public according to the County's shelter use plan and take whatever control measures are necessary for the protection and safety of the occupants. Section 2. Shelter Managers are authorized to use reasonable restraint against those who refuse to cooperate with the routine of shelter living under emergency conditions. Refusal to carry out the orders of the Shelter Manager and his appointed staff shall be deemed a misdemeanor punishable by a fine of not more than $200.00. HEFFERNAN, AND WIFE, LEOMA HEFFERNAN, FOR RIGHT OF WAY FOR STATE HIGHWAY 16 On this the 12th day of May, 1975, came on to be heard and considered by the Court the matter of acquiring a parcel of land designated by the Texas Highway Department as right of way Parcel No. 46 from Billy L. Heffernan and wife, Leonia Heffernan, for the reconstruction of State Highway 16, and it appearing to the Court that, as a result of prior negotiations an agreed consideration for the conveyance of the said Parcel No. 46 has been arrived at, it is ordered on motion by Commissioner Stone, seconded by Commissioner Schwethelm and unanimously approved by the Court that Kerr County offers to pay Billy L. Heffernan and wife, Leonia Heffernan, the sum of $1845.00 as compensation for land and damages for their convey- ance to the State of Texas a parcel of land comprising 0.721 acres out of Survey No. 1174, James Spicer, with payment being made upon approval for filing and recordation by the Texas Highway Department of their properly executed right of way deed, together with a partial release of an outstanding lien by First National Sank of Kerrville, which approval shall be conditioned on final title approval and payment of all ad valorem taxes, including current taxes heretofore assessed against the property conveyed, and it is further ordered that the Clerk and the Treasurer be authorized to draw a voucher on the Highway 16 right of way fund in the amount of $1845.00 payable to Billy L. Heffernan and wife, Leoma Heffernan, and First National Bank of Kerrville, which voucher shall be delivered upon final approval for filing and recordation by the Texas Highway Department of the right of way deed and partial release J, .ice
