ORDER AMENDING ORDER NO. 12, 214 RE: OFFER TO RIVERHILL CLUB &
ESTATES, LTD. FOR RIGHT OF WAY FOR STATE HIGHWAY NO. 16
On this the 13th day of January, 1975, came on to be heard and
considered the matter of amending Order No. 12, 214 entered on the 30th day of
August, 1974, and recorded in Volume N, Page 536 of the minutes of the Court,
in which Kerr County did make an offer to Riverhill Club and Estates, Ltd for right
of way for State Highway 16; and it appearing to the Court that Riverhill Club & Estates,
Ltd. , through their attorney, has by letter dated January 8, 1975, a copy of which
is filed as an exhibit hereto, requested that the total consideration for the conveyance
of the four parcels of right of way concerned, namely $32, 852. 50, be paid in part to
those lienholders who have executed and delivered partial releases of outstanding
liens against the four parcels of right of way concerned, it is ordered on motion
by Commissioner BiYt01 seconded by Commissioner Stone ,
and unanimously approved by the Court that the aforesaid Order No. 12, 214 be amended
to provide that the Clerk and the Treasurer be authorized to draw the following four
vouchers aggregating $32, 852.50 on the Highway 16 right of way fund for delivery
as per terms and conditions originally set forth in said Order No. 12, 214:

Dear Judge Nuenhoffer:
I hand you herewith four deeds from Riverhill Club & Estates, Ltd.
to the State of Texas each dated December 19, 1974, and conveying
four parcels of land containing respectively 8.785 acres, 1.510 acres,
.014 acres and .066 acre.
Also delivered to you herewith are four sparate partial
releases of lien, each executed by Kanella M. Turner and each dated
December 12, 1974, releasing the deed of trust lien held by Mrs.
Turner upon the four parcels of land described in the above mentioned
deeds.
Also delivered to you herewith are four partial releases of
lien each executed by Community Savings & Loan Assn. of Fredericksburg
and each dated December 13, 1974, releasing the deed of trust lien
held by such association upon the same four parcels of land.
Also delivered to you herewith are four partial releases of
lien executed by Community General Corporation, and dated December 13,
1974, releasing the lien held by such corporation upon the same four
parcels of land.
All such documents are in connection with the acquisition by the
State of Texas of additional right-of-way for widening and modification
of the route of State Highway No. 16.
In accordance With the previous agreement between us and the
commissioners court order in such regard a total consideration in
the sum of $32,852.50 will be due and payable upon closing of this
transaction. Please arrange for modification of the commissioners
court's order on this matter to provide for four separate checks to
be issued as followsa
