NO. 12602 P.ESOLUTION AND ORDER GIVING NOTICE OF INTENTION TO ISSUE $250,000 CERTIFICATES OF OBLIGATION OF KERB COUNTY, TEXAS THE STATE OF TEXAS T COUNTY OF KERB X OPi THIS, the 12th day of February, 1976, the Commissioners' Court of Kerr County, Texas, convened in regular session at the regular meeting place of said Court in the Courthouse at Kerrville, Texas, the meeting being open to the public and notice of such meeting having been given in advance as prescribed by Article 625?_-17, Section 3A, V.A.T.C.S., with the following members of the Court being present and. in attendance, to wit: JULIUS R. NEUNHOFFER CUiJNTY JUDGE, Presiding W. C. SCHYJETHELM COMMISSIONER, Precinct No. 1 CLINTON M. SALLEE COMMISSIONEF., Precinct No. 2 ADOLPH BARTEL COMMISSIONER, Precinct No. 3 KOGEK STONE COMMISSIONER, Precinct No. 4 and with the following absent: NONE, constituting a quorum; and among other proceedings had were the following: The County Judge submitted to the Court the following resolution and order for its consideration and passage, to wit: WHEREAS, under the provisions of The Certificate of Obligation Act of 1971, as amended, the Commissioners' Court of a County is authorized to issue certificates of obligation and sell the same for cash when current funds or bond funds are not adequate to permit the award- ing of a contract and to pay contracts for personal or professional services; and 14HEREAS, Kerr County has advertised for bids for a contract proposed to be let for the construction of an Annex to the County Courthouse; and LdHEREAS, i.t is anticipated that t41e contract proposed to be let by the County will exceed the amount of bond funds on hand and appropriated for the construction of the Annex to the Courthouse, which funds are to be received from the sale of the $860,000 "Kerr County, Texas, General Obligation Bonds, Series 1976," dated February 1, 1976; and P?HEREAS, to meet the deficiency in bond funds that may exist to permit the awarding of the aforementioned contractual obligation proposed to be incurred by the County and to pay contracts for personal or professional services of architects, engineers, attorneys and a -" financial adviser in connection with the construction and financing of the improvements and the addition to the existing County Courthouse, this Court hereby finds and determines that certificates of obligation of the County should be issued and notice of this Court's intention to issue such certificates in an amount not to exceed $250,000 for said purposes should now be given; therefore, BE IT RESOLVED AND ORDERED BY THE COMMISSIONERS' COURT OF KERR COUNTY, TEXAS: SECTION 1: That the County Clerk of Kerr County, Te:;as, is hereby authorized and direct- ed to cause notice to be published of t:he Court's intention to consider the passage of an order on the 8th day of March, 1976, at the Court's regular meeting place in the County Court- house, authorizing the issuance of certificates of obligation of the County in the maximum principal amount of $250,000 for the following purposes, to wit: (i) to permit the awarding of a contractual obligation for the construction of public work (the construction of an Annex to the Kerr County Courthouse) and (ii) to pay contracts for personal or professional services _ of architects, engineers, attorneys and, a financial adviser, such certificates to be payable from ad valorem taxes. The notice to he published (the form and content of which is hereby approved) shall read substantially as follows: NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION TAKE NOTICE that on the 8th day of March, 1976, the Commissioners' Court of Kerr County, Texas, during its regular meeting scheduled to ben in at 10:00 o'clock A. M., and at its regular meeting place in the County Courthouse at Kerrville, Texas, shall consider the passage of an order authorizing the issuance of certificates of obligation of said County in the maximum principal amount of $250,000 for the following purposes, to wit: (i) to permit the a~oarding of a contractual obligation for the construction of public work (the construction of an Annex to the Kerr County Courthouse) and (ii) to pay contracts for personal or professional services of architects, engineers, attorneys and a financial adviser, such certificates of obligation to be payable from ad valorem taxes. /s/ Emmie M. The above resolution and order having been read in full, it was moved by Commissioner Sallee and seconded by Commissioner Bartel that the same be passed and adopted. Thereupon, the question being called for, the County Judge put the motion to a vote of the members of the Commissioners' Court, and the motion carried by the following vote: County Judge Neunho£fer and Commissioners Schwethelm, Sallee, Bartel and :;tone; and none voted "NO", The County Judge declared the motion carried and the order passed and the Clerk was instructed to record same in the proper minutes of the Court. Seal) O-o-o-o-o-O-o-O-o-O NU. 12603 ORDEd NOTING RECEIPT OF LETTER OF IN`ENTION TO SUBMIT RESIGNATION OF THE TAX ASSESSOR-COLLECTOR OF KERR COUNTY AND MAKING APPOINTMENT TO FILL UNEXPIRED TERAi UPON EFFECTIVE DATE Or' PROPOSED RESIGNATION On this the 12th day of February, 1976 came on to be noted by the Court that Juanita Reeves Maples, the duly elected and c;ualified Tax Assessor-Collector of Kerr County, has filed with the Court a letter expressing her intention to submit a formal resignation as Kerr County Tax Assessor-Collector effective March 31, 1976 at 5:30 p. m.; and it appearing to the Court that it is the statutory duty of the Court 'to make an appointment to fill the vacancy and un- expired term of office which will result upor, the effective date of the proposed resignation; and it further appearing to the Court that an orderly transition of responsibility for the function and direction of the office of Tax Assessor-Collector of Kerr County requires a prompt appointment and decision, it is ordered on motion by Commissioner Stone, seconded by Commis- Lee sinner Sallee and unanimously approved by the Court that Doris/Smith, the presently serving
