COURT CONVENED IN SPECIAL SESSION FEBRUARY 23, 1976 at 9:00 o'clock A. M., with

SdHEREAS, the Commissioners` Court of Kerr County recognizes the current need for assist-
ance to the District Attorney of the 216t}'~7udicial District in the matter of trial preparation
and prosecution of criminal cases requirinrt trial by the District Court of the said Judicial
District; and,
WHEREAS, the Criminal Justice Division of the State of Texas has available certain funds
which may be employed for the purpose of initial funding for an Assistant District Attorney
for the 216th Judicial District; and
tifHERE:AS, it is necessary that a unit of local novernment make proper application for such
funds and assume responsibility for their expenditure;
NOW, THEREFORE, BE IT RESOLVED that Kerr County Commissioners' Court authorize and direct
the County Judge of Kerr County to make application in the name of Kerr County and to execute
such application for total funding in the amount of $n5,000.00 over a three year period,
including initial first year funding in the amount of $15,000.00, which application shall be
made to the Criminal Justice Division through the Alamo Area Council of Governments for the
purpose of establishing and funding the position of Assistant District Attorney for the 216th
Judicial District of the State of 'Pexas.
On motion by Commissioner Bartel, seconded by Commissioner Sallee, and unanimously
approved by the Court, the foregoing resolution caas duly adopted by the Commissioners' Court

NO. 12607 OFFER TO C. F. BIGGERSTAFF AND WIFE, JULIA R. BIGGERSTAFF, FOR RIGHT OF WAY FGR
STATE HIGHWAY 16
On this the 23rd day oŁ February, 1976, came on to be heard and considered by the Court
the matter of acquiring a parcel of land designated by the State Department of Highways and
Public Transportation as right of way Parcel No. 11 from C. F. Biggerstaff and wife, Julia R.
Biggerstaff for the reconstruction of a portion of State Highway 16 designated as Sidney
Baker Street South; and it appearing to the Court that, as a result of prior negotiations an
agreed consideration for the conveyance of the said Parcel No. 11 has been arrived at, it is
ordered on motion by Commissioner Stone, seconded by Commissioner Sallee and unanimously
approved by the Court that Kerr County offers to pay C. F. Biggerstaff and wife, Julia R.
Biggerstaff, the sum of $15,000.00 as compensation for damages for their conveyance to the ~'
State of Texas a parcel of land comprising 0.342 acres out of Survey No. 145 T. L. Waddell,
with payment being made upon approval for filing and recordation by the State Department

of Highways and Public Transportation of their properly executed right of way deed, cahich
approval shall be conditioned on final title approval and payment of all ad valorem taxes,
including current taxes heretofore assessed against the property conveyed, and it is further
ordered that the Clerk and the Treasurer be authorized to draw a voucher on the Highway 16
right of way fund in the amount of $15,000.00 payable to C. F. Biggerstaff and wife, Julia
R. Biggerstaff, which voucher shall be delivered upon final approval for filing and recorda-
tion by the State Department of Highways and Public Transportation of the right of way deed
aforesaid; - - - - - - - - - - - - - and it .is further ordered that in addition to the fore-
going, Kerr County will, at no e~:pense to the landowners reconstruct the existing fencing
alonr, Highway 16 on the new right of way line to the equivalent of present standards using the
existing fence material when practicable, otherwise nets materials of r_uality acceptable to
the landowners will be substituted.

NO. 12608 LEASE AGREEMENT BETWEEN CITY OF KERRVILLE AND KERB COUNTY - LESSORS AND DUGOSH
AIRCRAFT SERVICE CO., INC, LESSEE
On this the 23rd day of February 1976, anon motion made Y~y Commissioner Bartel, seconded
by Commissioner Sallee, the Court unanimously approved the lease agreement between the City
of Kerrville and Kerr County, Lessors and Dugosh aircraft Service Co., Inc., Lessee.

N0. 12609 AIRPORT MASTER PLAN APPROVED
On this the 23rd day of February 1976, upon motion made by Commissioner Stone, seconded
by Commissioner Schwethelm, the Court unanimously approved the Airport Master Plan, as nre-
pared by Bovay Engineers, Inc., for the City of Kerrville and Kerr County.

NO, 12610 APPROVAL OF CLAIMS AND ACCOUNTS
On this the 23rd day of February 1976, came on to be examined by the Court the various
claims and accounts against Kerr County and the respective Commissioners' Precincts since the
last term of Court, which claims and accounts were approved for payment by the Clerk and
Treasurer, in amounts and out of General Fund and Officers Salary Fund, as shown in the
Minutes of Accounts Allowed on page 1880 Voucher Y7os. 44548 thru 44551 which were
made a part of this order.
Motion made by Commissioner Bartel, seconded by Commissioner Stone and unanimously
approved by the Court.

On this the 23rd day of February 1976, upon motion made by Commissioner Sallee, seconded
by Commissioner Bartel, the Court unanimously approved the request of Juanita Reeves Maples,
Tax Assessor-Collector, tG refund payment of taxes for year 1975 io Julia R, Biggerstaff, in
the amount of $912.00, due to an error in assessment.
