Q ~3 __ - - _ - i the English language, in .Kerr County, Texas, for at least three weeks prior to the action .__. ~, on said Application to Cancel Subdivision; that such notice of this said court did set a specific time, date and place to hold a hearing on said application; that the said hearing of this action action of the Commissioner's Court did occur at a regular term of said court; further this said notice did command that any person interested in such lands to appear at the time specified in such notice to protest, if desired, against such action and that all ', prerequisite required by law to cancel said subdivision have in all things been performed, occurred, accomplished and complied with. The said Commissioner's Court further finds that neither such Indian Springs Ranch Estates subdivision nor any of the lands located within said subdivision are located in any incorporated city or town. The Commissioner's Court further finds that the said owners, by and through their attorney, appeared and requested the approval of such Application to Cancel Subdivision; that no person appeared to protest against such application and that the said Commissioner's Court should enter an order cancelling said subdivision and spread upon the minutes of this court, its order authorizing such owners of such lands to cancel the sane by written instrument, describing such subdivision as a whole, provided, however, that nothing herein shall be construed as a cancellation of the paved county roadway, commonly known and designat- ed as the Fisher Road as the same existed prior to the filing of such platted subdivision. It is therefore, ORDERED, ADJUDGED and DECREED by the Commissioner's Court of Rerr County, Texas, that Carl M. Hawkins and wife, Diane C, Hawkins, and Willis M. Powell, Jr., Floyd Ames Smith, Elbert Watson, Robert L. Gorden, John L, Hill, Bertha W. Trotter, James M. Adkins, Dewitt R. Gayle and Natalie L. Gayle, the owners of all of the lands located, lying and being situated within the Indian Springs Ranch Sstates, a subdivision located, lying and being situated in Kerr County, Texas, as more fully shows by the platted subdivision thereof, recorded in Volume 3, page 68, Plat Records of Kerr County, Texas, to which plat and its record reference is here made for all purposes, be and they are hereby authorized _ to wholly cancel such subdivision pursuant to Article 7227, V.T.C.S. by written instrument describing such subdivision as a whole, provided, however, that such written instrument shall specify that nothing contained therein shall be constured as a cancellation of the paved county roadway commonly known and described as the Fisher Road as the same existed prior to the filing of such platted subdivision.
