the English language, is Kerr County, Texas, for at least three weeks prior to the action
on said Application to cancel Subdivision; that such notice of this said court did set a
specific time, date and place to hold a hearing on said application; that the said hearing
of this action action of the Commissioner's Court did occur at a regular term of said court;
further this said notice did command that any person interested in such lands to appear at
the time specified in such notice to protest, if desired, against such action and that all
prerequisits required by law to cancel said subdivision have in all things been performed,
occurred, accomplished and complied with.
The said Commissioner's Court further finds that neither such Indian Springs Ranch
Estates subdivision nor any of the lands located within said subdivision are located in any
incorporated city or town.
The Commissioner's Court further finds that the said owners, by and through their
attorney, appeared and requested the approval of such Application to Cancel Subdivision;
that no person appeared to protest against such application and that the said Commissioner's
Court should enter an order cancelling said subdivision and spread upon the minutes of this
court, its order authorizing such owners of such lands to cancel the same by written
instrument, describing such subdivision as a whole, provided, however, that nothing herein
shall be construed as a cancellation of the paved county roadway, commonly known and designat-
ed as the Fisher Road as the same existed prior to the filing of such platted subdivision.
it is therefore, ORDERED, ADJUDGED and DECREED by the Commissioner's Court of Rerr
County, Texas, that Carl M. Hawkins and wife, Diane C. Hawkins, and Willie M. Powell, Jz.,
Floyd Amea Smith, Elbert Watson, Robert L. Gorden, John L. Hill, Bertha W. Trotter, James
M. Adkins, Dewitt R. Gayle and Natalie L, Gayle, the owners of all of the lands located,
lying and being situated within the Indian Springs Ranch 8atates, a subdivision located,
lying and being situated in Kerr County, Texas, as more fully shown by the platted subdivision
thereof, recorded in Volume 3, page 68, Plat Records of Kerr County, Texas, to which plat
and its record reference is here made for all purposes, be and they are hereby authorized
to wholly cancel such subdivision pursuant to Article 7227, V.T.C.S, by written instrument
describing such subdivision as a whole, provided, however, that such written instrument shall
specify that nothing contained therein shall be constured as a cancellation of the paved
county roadway commonly known and described as the Fisher Road as the same existed gzior to
the filing of such platted subdivision.

On Chia the 8th day of Much 1976, upon motion made by Commissioner Schwethelm, seconded
by Commissioner Sallee, the Court unanimously approved the Plat of Montebello Estates,
subject to the provisions that actual maintenance of roadways will not be assumed by Kerr
County until residential development shall justify said maintenance.

that the sum of $100,000.00 should be invested and the proceeds thereof deposited to the

County, Texas, from bond sale proceeds, out of Kerr County Courthouse Renovation Fund, in
the amount of 5100,000.00.
It is ordered on motion by Commissioner Bartel, seconded by Commissioner Sallee and
unanimously approved by the Court, that the sum of 5100,000.00 out of Kerr County Courthouse
Renovation Fund be invented in an interest Hearing Certificate of Deposit with Chas.
Schreiner Hank, which investment shall be made as soon as practicable and that such Certifi-

the matter of employing professional :ervicea for preparing plena and specifications for
remodeling the present courthouse, including heating system renovation; and it appearing
to the Court that previous work done for the County by Lester B. Whitton has been completed
in commendable manner, and it further appearing to tho Court that this work should be done
by one or more of the principals presently responsible for the additional courthouse office
space sad the City/County jail; it is ordered on motion by Commissioner Bartel, seconded
by Commissioner Sallee, and unanimously approved by the Court that the professional services
of Lester B. Whitton be employed to prepart plans sad specifications for remodeling the
present courthouse, including heating ayatem renovations, pursuant to such aritten contract
as may be agreed upon and entered into with Kerr County.

On this the 8th day of xarch, 1976, came on to be heard and considered by the Court
the matter of acquiring a parcel of land designated by the State Department of Highways and
Public Transportation as right of nay Pascei No. 42 from Donald B. Gillett for the reconstruc-
tion of State Highway 16, and it appearing to the Court that, as a result of prior negotia-
tlona an agreed consideration for the conveyance of the said Parcel No. 42 has been arrived
at, 1t is ordered on motion ,by Commissioner Schwethelm, seconded by Commissioner Sallee,
and unanimously approved by the Court that Kers County offers to pay Donald B. Gillett, a
