OFFER TO KERRVILLE 16, LTD. FOR RIGHT OF WAY FOR
STATE HIGHWAY 16
On this the 2nd day of February, 1976, came on to be heard
and considered by the Court the matter of acquiring a parcel of land
designated by the State Department of Highways and Public Transportation
as right of way Parcel No. 3A from Kerrville 16, LTD. , a Limited
Partnership, for the reconstruction of the portion of State Highway 16
designated as Sidney Baker Street, South; and it appearing to the Court
that, as a result of prior negotiations an agreed consideration for the
conveyance of the said Parcel No. 3A has been arrived at, it is ordered
on motion by Commissioner SChwethelm seconded by
Commissioner _- Stone and unanimously approved by the Court
that Kerr County offers to pay Kerrville 16, LTD, the sum of $15, 560. 00
as compensation for land and damages for the conveyance to the State
of Texas a parcel of land comprising 0.376 acres out of Surveys No. 144,
J. H. Cocke and 145 T. L. Waddell, with payment being made upon
approval for filing and recordation by the State Department of Highways
and Public Transportation of the Limited Fartnership's properly executed
right of way deed, together with a partial release of an outstanding lien
by G. E. Lehmann and Gordon H. Monroe, which approval shall be
conditioned on final title approval and payment of all ad valorem taxes,
including current taxes heretofore assessed against the property conveyed;
and it is further ordered that the Clerk and the Treasurer be authorized
to draw a voucher on the Highway 16 right of way fund in the amount of
$15, 560. 00 payable to Kerrville 16, LTD. , G. E. Lehmann and Gordon H.
Monroe, which voucher shall be delivered upon final approval for filing
and recordation by the State Department of Highways and Public Transportation
of the right of way deed and partial release of lien as aforesaid.
