ORDER NO. 12607 OFFER TO C. F. BIGGERSTAFF AND WIFE, JULIA. R. BIGGERSTAFF, FOR RIGHT OF WAY FOR STATE HIGHWAY 16 On this the 23rd day of February, 1976, came on to be heard and considered by the Court the matter of acquiring a parcel of land designated by the State Department of Highways and Fublic Transportation as right of way Parcel No. 11 from C. F . Biggerstaff and wife, Julia R. Bigger staff for the reconstruction of a portion of State Highway 16 designated as Sidney B aker Street South; and it appearing to the Court that, as a result of prior negotiations an agreed consideration for the conveyance of the said Parcel No. 11 has been arrived at, it is ordered on motion by Commissioner Stone seconded by Commissioner Sallee , and unanimously approved by the Court that Kerr County offers to pay C. F. Biggerstaff and wife, Julia R. Biggerstaff, the sum of $15, 000. 00 as compensation for damages for their conveyance to the State of Texas a parcel of land comprising 0.342 acres out of Survey No. 145 T. L. Waddell, with payment being made upon approval for filing and recordation by the State Department of Highways and Public Transportation of their properly executed right of way deed, which approval shall be conditioned on final title approval and payment of all ad valorem taxes, including current taxes heretofore assessed against the property conveyed, and it is further ordered that the Clerk and the Treasurer be authorized to draw a voucher on the Highway 16 right of way fund in the amount of $15,000.00 payable to C. F. Biggerstaff and wife, Julia R. Biggerstaff, which voucher shall be delivered upon final approval for filing and recordation by the State Department of Highways and Public Transportation of the right of way deed aforesaid; and it is further ordered that in addition to the foregoing, Kerr County will, at no expense to the landowners reconstruct the existing fencing along Highway 16 on the new right of way line to the equivalent of present standards using the existing fence material when practicable, otherwise new materials of quality acceptable to the landowners will be substituted.
