OFFER TO LEE M. BATLEY AND WIFE, WILLIE M. BATLEY FOR
RIGHT OF WAY FOR 5TA'IE HIGHWAY 16
On this the 20~ day of July, 1976, came on to be heard and considered
by the Court the matter of acquiring a parcel of land designated by the State
Department of Highways and Public Transportation as right of way Parcel
No. 45 from Lee M. Batley and wife, Willie M. Batley, for the reconstruction
of State Highway 16; and it appearing to the Court that, as a result of prior
negotiations an agreed consideration for the conveyance of the said Parcel
No. 45 has been arrived at, it is ordered on motion by Commissioner
Schwethelm seconded by Commissioner Stone ,
and unanimously approved by the Court that Kerr County offers to pay
Lee M. Batley and wife, Willie M. Batley, the sum of $300.00 as
compensation for land and damages for their conveyance to the State of Texas
a parcel of land comprising 0.048 acres out of Survey No. 1174, James
Spicer, with payment being made upon approval for filing and recordation by
the State Department of Highways and Public Transportation of their properly
executed right of way deed, which approval shall be conditioned on final title
approval and payment of all ad valorem taxes, including current taxes heretofore
assessed against the property conveyed, and it is further ordered that the
Clerk and the Treasurer be authorized to draw a voucher on the Highway 16
right of way fund in the a=nount of $300.00 payable to Lee M. Batley and wife,
Willie M. Batley, which voucher shall be delivered upon final approval for
filing and recordation by the State Department of Highways and Public
Transportation of the right of way deed as aforesaid.
