ORDER NO, 12$03 OFFER TO THE ESTATE OF ROBERT L. 5PICER, DECEASED AND PATRICIA L. SPICER PETERS FOR RIGHT OF WAY FOR STATE HIGHWAY 16 On this the 19th day of October, 1976, came on to be heard and considered by the Court the matter of acquiring a parcel of land designated by the State Department of Highways and Public Transportation as right of way Parcel No. 34 from the Estate of Robert L. Spicer, Deceased, and Patricia L. Spicer, individually and as surviving widow of Robert L. Spicer, Deceased, for the reconstruction of State Highway 16; and it agpearing to the Gourt that, as a result of prior negotiations an agreed consideration for the conveyance of the said Parcel No. 34 has been arrived at, it is ordered on motion by Commissioner ~t,p~y@ , seconded by Commissioner SChwethelII and unanimously approved by the Gourt that Kerr County offers to pay the Estate of Robert L. Spicer and Patricia L. Spicer Peters the sum of $1, 780. 00 as compensation for land and damages for their conveyance to the State of Texas a parcel of land comprising 0.731 acres out of Survey No, 1174, James Spicer, and Survey 406, Lyman M. Stewart, with payment being made upon approval for filing and recordation by the State Department of Highways and Public Transportation of their properly executed right of way deed, which approval shall be conditioned on final title approval and payment of all ad valorem taxes, including current taxes heretofore assessed against the property conveyed, and it is further ordered that the Clerk a nd the Treasurer be authorized to draw a voucher on the Highway 16 right of way fund in the amount of $1,750.00 payable to Robert H. Spicer, Independent Executor of the Estate of Robert L. Spicer, Deceased, and to Patricia L. Spicer Peters, which voucher shall be delivered upon final approval for filing and recordation by the State Department of Highways and Public Transportation of the right of way deed as aforesaid.
