ORDER NO. 12931 OFFER TO MARGARET N. RUSCH AND HUSPAND, LEROY RUSCH, FOR RIGHT OF WAY FOR THE EXTENSION OF F.M. ROAD 1341 On this the 18th day of February, 1977 came on to be heard and considered by the Curt the matter of acquiring a parcel of land designated by the State Department of Highways and Public Transportation as Parcel No. 3, together with a channel easement designated as Parcel 3(E), from Margaret N. Rusch and husband, LeRoy Rusch, for the extension of F.M. Road 1341 from its present eastern terminus to the Cypress Creek Road exit of Interstate Highway 10; and it appearing to the Court that, as a result of prior negotiations an agreed consideration for the conveyance of the said Parcels Nos. 3 and 3(E) has been arrived at, it is ordered on motion by Commissioner Lich seconded by Commissioner StOAź and unanimously approved- by the Court that Kerr County offer to pay Margaret N. Ru sch and husband, LeRoy Rusch, the sum of $9,215.00 as compensation for land and damages, including fencing costs, for their con- veyance to the State of Texas of a parcel of land comprising 5.690 acres of land out of T. J. Golightly Survey No. 379, P. Nuernburger Survey No. 689 and W. T. Austin Survey No. 377, together with a channel 'easement com- prising 0.057 acres out of Survey 379, which 5.690 parcel consists of 4.135 acres of new right of way and 1.555 acres situated within the existing County roadway, with payment being made upon their delivery to Kerr County of their properly executed right of way deed and channel easement; and it is further ordered that the Clerk and the Treasurer be authorized to draw a voucher on the F. M. 1341 right of way fund in the amount of $9,215.00 payable to Margaret N. Rusch and husband, LeRoy Rusch, which voucher shall be delivered upon the delivery of their executed right of way deed and channel easement. ORDER NO, 12931 OFFER TO MARGARET N.
