ORDER AMENDING ORDER NO. 12922, OFFER TC WALTER KUTZER AND
WIFE, LORIETTA KUTZER, FOR RIGHT OF WAY FOR THE EXTENSION OF
FM RCAD 1341
On this the 14th day of March, 1977, came on to be heard
and considered by the Court the matter of amending Crder No. 12922 entered
by the Court on the 14th day of February, 1977, which order sets forth an
offer to Walter Kutzer and wife, Lorietta Kutzer for a parcel of right of way
for the extension of FM Road 1341; and it appearing to the Court that the said
right of way parcel designated as parcel #15 has been revised and recalculated
as to area so that it now comprises 0.868 acres of land out of John Clark
Survey No. 375, consisting of 0.795 acres of new right of way and 0.073 acres
situated within the existing County roadway; and it further appearing to the
Court that the aforesaid adjustment has altered the amount of right of way
fencing involved so that the total amount of compensation due the landowners
for their conveyance of the said parcel #15 has been recalculated to be
$2,457.72 rather than the sum of $2,291.63 authorized to be paid to the said
landowners pursuant to the provisions of the said Order No. 12,922, therefore
an additional sum of $166.09 is due the said Walter and Lorietta Kutzer, it
is ordered on motion by Commissioner Sallee seconded by
Commissioner Iieh and unanimously approved by the Court that
Kerr County pay Walter Kutzer and wife, Lorietta Kutzer an additional sum
of $166.09as compensation for land and damages for their conveyance to the
State of Texas of the said right of way parcel #15; and ~t is further ordered that
the Clerk and the Treasurer be authorized to draw an additional voucher on
the F. M. 1341 right of way fund in the amount of $166. 09 payable to Walter
Kutzer and wife, Lorietta Kutzer.
