We propose to act as Agent for the airport sponsor- iCity of Kerr- ville and County of Kerr) on a best efforts basis in negotiating with owners of the land to be acquired. Legal work, land appraisals, and boundary surwi~ys of the tracts will be provided by the sponsor. Acquisition must be in accord- ance with the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 7970 (P.l. 91-258), commonly referred to as the Uniform Act, if FAA is to participate in acquisition costs. FAA Advis~:,ry Circular No. 150/5100-iT, dated February i0, i975 and other publicatiorrs explain in detail the requirements of the Uniform Act and are attached to this proposal for the purpose of defining the services of the negotiator. Costs incurred by attorneys, appraisers, surveyors, and negotiai:ors are regarded as incidental expenses related to land acqusition and are eligible for FAA participation only if performed in accordance with tfie Uniform Act. The Houston FAA office advises that they do not need to approve contracts for services required for acquisition of land. We propose that reimbursement for our time, travel, iivinr and ether direct expenses in connection vaith negotiations with property owners be on an hourly basis n accordance with the attached Schedule of Hourly Charges b,; Personnel Classification, KD/1u76-2. Since it is not known at this time ;f the acquisition rti•i'.? be a simple or complicated process involving condemnation, or if relocation assistance will be required, it is difficult to estimate the amount of time that will i7e ~ •;uired on our part but we will keep you informed as to time and expenses incurr°ed and will make every effort to minimize our effort by suggesting use of City or Cuunty staff where possible. Tirne a:lr: expenses for appearances in court if condemnation is required will be reimbursed in accordance with the attached Per Diem Fee Schedule, Expert `rlitness Assign- ments, KD/7076-4. Reimbursement for our time al;d expenses will be made monthly as provided on the two fee schedules above regardless of when FAA or Tex,: Aeronautical Commission participation occurs.
