M. 1338 IN KERR COUNTY, TEXAS FOR A CHANNEL EASEMENT AREA OF EQUIVALENT UTILITY On this the 13th day of Dlarch 1978, upon motion made by Commissioner Stone, seconded by Commissioner Sallee, the Court unanimously approved the following RESOLUTION: REQUESTING THE STATE HIGHWAY AND PUBLIC TRANSPORTATION COMMISSION TO EXCHANGE AN EXISTING DRAINAGE CHANNEL EASEMENT APPURTENANT TO F. M. 1338 IN KERR COUNTY, TEXAS FOR A CFIANNEL EASEMENT AREA OF EQUIVALENT UTILITY WHEREAS, by Right of Way Easement dated June 18, 1952, recorded in Volume 2, Page 97 of the Easements Records of Kerr County, Texas, a 0.073 acre drainage channel easement was conveyed to the State of Texas, a copy of said Easement instrument being attached hereto as Exhibit "A"; and [+7HEREAS, W. L. Blair, the present owner of the underlying fee simple title to that I certain property burdened in part by said easement, desires to develop and improve said property which development will require the surface utilization of said easement, said 0.073 acre being described in attached Exhibit "B"; and WHEREAS, W. L. Blair has proposed and agreed to convey an easement for drainage channel purposes over and across an additional 0.073 acre tract of said land to the State of Texas to replace the 0.073 of one acre of the existing easement; and -7EREAS, the said 0.073 of one acre o£ said existing easement will no longer be needed for the use of citizens for highway purposes after the State acquires the said new 0.073 acre easement; IT IS, THEREFORE, REQUESTED by the Commissioners' Court of Kerr County, Texas, at its regular meeting that the State Highway and Public Transportation Commission pass an appropriate Minute Order declaring said 0.073 (Exhibit "A") of one acre drainage channel easement to be surplus right of way and that all right, title and interest in and to said 0.073 0£ one acre tract of land be quitclaimed by the State of Texas to the Owner of the Fee in the land in full exchange for an additional 0.073 acre drainage easement. H.
