SALLEE Commissioner Precinct No. 2 VICTOR LICH Commissioner Precinct No. 3 and the Court having duly opened, the following proceedings were had: NO. 13451 APPROVAL OF 1978 TAX ROLL BY BOARD OF EQUALIZATION On this the 19th day of September 1978, with the County Judge and County Commissioners sitting as a Board of Equalization, did carefully examine the Tax Rolls made up from the approved assessments by Doris Lee Smith, Tax Assessor-Collector for Kerr County, Texas, for the year 1978 and did find that all Surveys and parts of Surveys of land, and all lots and blocks of the Cities and Towns of this County and all personal property, insofar as they were able to ascertain have been assessed for taxes for the year 1978, at its true and full market or real value. SALLEE Commissioner Precinct No. 2 VICTOR LICH Commissioner Precinct IQo. 3 and the Court having duly opened, the following proceedings were had: NO. 13452 APPROVAL OF RESOLUTION -- RE: FEDERAL DISASTER ASSISTAI~ICE ADMINISTRATION On this the 21st day of September 1978, upon motion made by Commissioner Sallee, seconded by Commissioner Lich, the Court unanimously approved the following RESOLUTION: bVHEREAS, on the 3rd day of August, 1978, the President declared a "major disaster" in the State of Texas under the provisions of Public Law 288, 93rd Congress, and Y7HEREAS, Kerr County, Texas is a public entity within said State; NOW THEREFORE, BE IT RESOLVED, by the Commissioners' Court of Kerr County that the Federal Disaster Assistance Administration be and hereby is requested to arrange to have the appropriate Federal Agency perform the following work: The removal of flood generated debris from designated areas within Kerr County as may be agreed upon by Kerr County and the Federal agencies concerned. This body certifies that, to the best of its knowledge and belief, the requested work is eligible under Public Law 283, 93rd Congress, and agrees to (a) provide without cost to the United States all lands, easements, and right of way necessary to accomplishment of the approved work; _ _ _ - _ _ _ _ ._ .. .. ._ .. _ .. _ _ _ _ _ _ _ _ _ _ _ _ _ _ and (b) hold and save the United States free from damages due to the approved work and with respect to debris removal shall indemnify the Federal Government against any claim arising from such removal. OLDFIN FOR RIGHT OF WAY FOR LOOP 534 On this the 21st day of September, 1978 came on to be heard and considered by the Court the matter of compensation to be paid John G. Oldfin as compensation for his conveyance to the State of Texas of a parcel of land required for right of way for the construction of Loop 534, which land comprises 2.721 acres of land out of Survey No. 115, Thomas Hand, and is designat- ed as Parcel No. 25 of said right of way; and it appearing to the Court that an agreed amount of compensation has been arrived at, it is ordered on motion by Commissioner Lich, seconded by Commissioner Sallee, and unanimously approved by the Court that Kerr County offer to pay John G. Oldfin the sum of $8,850.00 as compensation for land and damages for his conveyance to the State of Texas of Parcel 25 as aforesaid, subject to the execution and delivery with executed right of way deed of a partial release of a lien and deed of trust as to the parcel conveyed by the lienholder, Carolyn Chapman; and it is further ordered that on approval for filing by the State Department of Highways and Public Transportation of the aforesaid right of way deed and partial release of lien, and on final title approval a voucher shall be drawn in the amount of $8,850.00 on the Loop 534 Right of 69ay Fund, payable to John G. Oldfin and Carolyn Chapman, provided however that in the event there remain unpaid ad valorem taxes levied against the portion of Thomas Hand Survey No. 115, owned by John G. Oldfin, including 1978 ad valorem taxes, Kerr County reserves the right to deduct the amount of such unpaid taxes and penalty and interest, if any, from the total compensation hereby offered and to pay the same to the taxing agencies concerned. o-o-o-o-o-o-o-o-o-o COURT ADJOURNED SEPTEMBER 21st, 1978 at 10:30 o'clock A.
