SHE STATE OF TEXAS § THE COUNTY OF KERR § This AGREEMENT made and entered into by and between KERR COUNTY, TEXAS, acting herein by and through its Commissioner's Court, hereinafter called "County", and UPPER GUADIALUPE RIVER AUTHORITY, acting herein by and through its duly constituted Board of Directors, hereinafter called "Authority", W I T N E S S E T H WHEREAS, County has heretofore entered its ORDER establishing a construction permit system and adopted regulations requiring permits for construction in flood pka~.ns areas having such flood hazards, providing for the review of subdivisions, providing for administration and enforcement of the regulations, and making provisions relating to construction within the counties designated flood plains; and WHEREAS, County desires to utilize the services of the General Manager of the Upper Guadalupe River Authority, as the office of County Flood Plain Administrator; and WHEREAS, Authority has agreed with County that its General Manager may act as the County Flood Plain Administrator, in addition to his other duties: NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that County for and in consideration of the services to be rendered by Authority in permitting its General Manager to serve as County Flood Plain Administrator under the ORDER of the County, hereinabove referred to, County agrees to pay to Authority, the sum of $5,000.00 per annum for such services; PROVIDED, HOWEVER, that from such $5,000.00 annual payment the County shall deduct a sum of money equal to the fees collected by Authority under the provisions of the ORDER above referred to. ~- It is further agreed that such annual payment of $5,000.00 shall be made in semi-annual payments beginning on January 15, 1978, and a like payment to be made on the 15th day of each July and January during the time this AGREEMENT shall remain in effect. Such $2,500.00 payments, in each case, shall be subject to the deduction by County of the fees collected by Authority during the next preceding six (6) months. It is agreed and understood either party to this AGREEMENT may terminate the same by giving the other party not less than ninety (90) days written notice. ORDER NO. 13191 ORDER ESTABLISHING BUILDING PERMIT FEE WITHIN FLOOD HAZARD AREAS OF KERB COUNTY On this the 21st day of December 1977, upon motion made by Commissioner Lich, seconded by Commissioner Stone, the Court unanimously approved an order Establishing Building Permit Fee Within Flood Hazard Areas of Kerr County in the amount of $20.00, effective upon implementation of the Regulation for Flood Plain Management. ~' %~~ .
