the necessity of authorizing and directing County Attorney James C. TQogues to act on behalf
of Kerr County and the State of Texas in the matter of intervening and filing claims in -the
198th Judicial District Court of Kerr County, pursuant to Article 7345b, Texas Civil Statutes,

It appearing to the Court that the Kerr County Tax Collector has been heretofore served
with Citation in said causes on behalf of Kerr County and the State of Texas and that inter-
vention and filing of a claim in these causes is required to preserve the claims of I:err
County and the State of Texas arising from delinquent taxes due them and constituting a lien

on the property which is subject to the said delinquent tax suits, it is ordered on motion
by Commissioner Lich, seconded by Comriissioner Speakmon, arrd unanimously approved by the
Court that the County Attorney be authorized and directed to proceed to file an intervention
in the said causes as above set forth and otherwise proceed according to law in this matter.

66TH LEGISLATURE, CANVASSED & TABULATED
On this the 5th day of February 1979, came on to be considered by the Court the returns
to be canvassed, to determine the results of the Second Special Election to Fill Vacancy in
Office of State Representative, 56th District, Unexpired Term, 66th Legislature, held on
February 3rd, 1979. And the Court having canvassed and tabulated 'the returns of the Election
Precincts and the Absentee Canvassing Board Box, are of the opinion that said returns, after
having been opened and canvassed are true and correct and should be approved.
Therefore, upon motion made by Commissioner Garrett, seconded by Commissioner Lich, the
Court unanimously approved that the returns as canvassed and tabulated in Volume 6, Page 36,
Record of Election Returns of Kerr County, Texas, and as certified thereto by each member of
the Court, are in all respects approved.

NO. 13593 ORDER APPROVING PAYMENT OF ELECTION OFFICERS AND RENT, ETC. FOR USE OF BUILDINGS
IN HOLDING SPECIAL ELECTIOTQ OIQ FEBRUARY 3rd, 1979
On this the 5th day of February 1979, upon motion made by Commissioner Speakmon, second-
ed by Commissioner Guthrie, the Court unanimously approved the payment of claims of the
Election Officials as per claims on file at $2.50 per hour and the Presiding Judges $10.00

for bringing in returns of Election, including the Absentee Box, and payment to various
places for the use of buildings, heat, lights, etc., in holding Second Special Election to
fill vacancy in the office of State Representative, 56th District, Unexpired Term, 66th
Legislature, held on February 3rd, 1979.

NO. 13594 APPROVAL OF PLAT OF PART OF BLOCI: 82, J. A. TIVY ADDITION TO THE CITY OF IhERRVILLE
On this the 5th day of February 1979, upon motion made by Commissioner Lich, seconded
by Commissioner Speakmon, the Court unanimously approved the Plat of Part of Block 82, J. A.
Tivy Addition, to the City of I:errville.

NO. 13595 APPROVAL OF RE-PLAT OF TRACTS 36 thru 40, VERDE CREEK ESTATES
On this the 5th day of February 1979, upon motion made by Commissioner Speakmon, second-
ed by Commissioner Lich, the Court unanimously approved the Re-Plat of Tracts 36 thru 40 of
Verde Creek Estates, subject to the provisions that actual maintenance of roadways will not
be assumed by Kerr County, until residential development shall justify said maintenance,
' provided however, that Kerr County does not accept as a County roadway, the road easement
dedicated for public use and designated as Cypress Drive and further, that Kerr County does
not assume responsibility Łor repairs, maintenance or reconstruction of the said Cypress
Drive, or any portion thereof.

On this the 5th day of February 1979, upon motion made by Commissioner Guthrie, seconded

and 28-A thru 38-F of Highforest Estates, subject to the provisions that actual maintenance
of roadways will not be assumed by Kerr County, until residential development shall justify
said maintenance.

NO. 13597 ORDER APPROVIIQG AGREEMENT BETWEEN RERR COUNTY ATdD PERRY LICH AND CALVIN B. PFEIFFER
RELATIVE TO USE OF A PORTION OF CYPRESS CREEK COUNTY ROAD ADJACENT TO F. M. ROAD

On this the 5th day of February, 1979 came on to be heard and considered by the Court
a proposed agreement between Kerr County and Perry Lich and Calvin B. Pfeiffer, abutting

landowners, relative to the use of a portion of the Cypress Creek County Road adjacent to

F. bI. Road 1341; and it appearing to the Court that an agreement has been reached that is
satisfactory to the said Perry Lich and Calvin B. Pfeiffer and to the Commissioner of Precinct
3 under whose jurisdiction the said portion of roadway has been maintained, it is ordered on
motion by Commissioner Lich, seconded by Commissioner Garrett and unanimously approved by the
Court that Kerr County approve the said proposed agreement as heretofore signed by Perry
Lich and Calvin B. Pfeiffer and that the County Judge of Kerr County be authorized to sign
the said agreement on behalf of Kerr County, whereupon it shall be recorded in the minutes
of the Commissioners' Court as an appendix to this order.
