PFEIFFER RELATIVE TO USE OF A PORTION OF CYPRESS CREEK COUNTY ROAD ADJACENT TO F. M. ROAD 1341 On this the 5th day of February, 1979 came on to be heard and considered by the Court a proposed agreement between Kerr County and Perry Lich and Calvin B. Pfeiffer, abutting landowners, relative to the use of a portion of the Cypress Creek County Road adjacent to ~~ l- i, . F. bi. Road 1341; and it appearing to the Court that an agreement has been reached that is satisfactory to the said Perry Lich and Calvin B. Pfeiffer and to the Commissioner of Precinct 3 under whose jurisdiction the said portion of roadway has been maintained, it is ordered on motion by Commissioner Lich, seconded by Commissioner Garrett and unanimously approved by the Court that Kerr County approve the said proposed agreement as heretofore signed by Perry Lich and Calvin B. Pfeiffer and that the County Judge of Kerr County be authorized to sign the said agreement on behalf of Kerr County, whereupon it shall be recorded in the minutes of the Commissioners' Court as an appendix to this order. AGREEMENT BETWEEN KERR COUNTY AND PERRY LICH AND CALVIN B. PFEIFFER RELATIVE TO USE OF A PORTIOIQ OF CYPRESS CREEK COUNTY ROAD ADJACENT TO F. M. ROAD 1341 This agreement is entered into this the 5th day of February, 1979 between Kerr County, acting by and through its County Judge, hereunto duly authorized pursuant to the provisions ~~~ '. of Commissioners' Court Order #13597 entered on the 5th day of February, 1979, and Perry r Lich and Calvin B. Pfeiffer, abutting landowners, relative to the status and use of a portion of the Cypress Creek County Road lying to the East of the Right of Way of F. M. Road 1341, and between the lands of Calvin B. Pfeiffer and Perry Lich. It is agreed that that portion of the Cypress Creek County Road left outside of and to the East of the F. P4. 1341 right of way and commencing in the proximity of Station 33 + 60 of the F. M. 1341 right of way will continue to be maintained by Kerr County as an open public road to a point just south of the old existing entrance Lo the Calvin B. Pfeiffer property. Calvin B. Pfeiffer shall be authorized to proceed at his discretion to place a gate across the County roadway just south of his entrance and to lock the same provided that the County Commissioner of the precinct and his employees shall be furnished with necessary keys to permit their access to the County roadway south of this point for the purposes hereinafter set forth: Kerr County acting by and through its County Commissioner of the precinct and his employees shall at all times have an uninterrupted right of access through the otherwise locked gate for the purpose of; 1. Stockpiling road construction materials; 2. Temporary parking of road equipment; 3. Access to the concrete bridge at the south end of the segment of County roadway which is the subject of this agreement for the purpose of taking water from Cypress Creek for use in conjunction with road work. It is further agreed that the old concrete bridge within the County roadway shall not be removed without the consent of Kerr County, and I:err County may, at its discretion, make any necessary repairs or other maintenance necessary to preserve the said bridge. Kerr fy~~ County also reserves the right to route temporary public traffic across the said bridge ~~ a.nd roadway in the event of any emergency which might render the adjacent F. M. Road 1341 over Cypress Creek impassable. Either or both the said Perry Lich or Calvin B. Pfeiffer may construct and maintain a fence across the south end of the County roadway in the proximity of the old Cypress Creek bridge and along the East right of way line of F. M. Road 1341 between approximate Stations 46 and 47 of the centerline of F. M. Road 1341; however Kerr County reserves the right to place and maintain a locked gate south of the old bridge should it be deemed necessary. It is further agreed that nothing herein shall be deemed to constitute any agreement or determination as to the ownership or record title of the lands lying beneath that portion of the County roadway which is the subject of this agreement.
