~~! i ~ of Commissioners' Court Order #13597 entered on the 5th day of February, 1979, and Perry Lich and Calvin B. Pfeiffer, abutting landowners, relative to the status and use of a portion of the Cypress Creek County Road lying to the East of the Right of Way of F. M. Road 1341, and between the lands of Calvin B. Pfeiffer and Perry Lich. It is agreed that that portion of the Cypress Creek County Road left outside of and to the East of the F. PA. 1341 right of way and commencing in the proximity of Station 33 + 60 of the F. b4. 1341 right of way will continue to be maintained by Kerr County as an open public road to a point just south of the old existing entrance to the Calvin B. Pfeiffer property. Calvin B. Pfeiffer shall be authorized to proceed at his discretion to place a gate across the County roadway just south of his entrance and to lock the same provided that the County Commissioner of the precinct and his employees shall be furnished with necessary keys to permit their access to the County roadway south of this point for the purposes hereinafter set forth: Kerr County acting by and through its County Commissioner of the precinct and his employees shall at all times have an uninterrupted right of access through the otherwise locked gate for the purpose of; 1. Stockpiling road construction materials; 2. Temporary parking of road equipment; 3. Access to the concrete bridge at the south end of the segment of County roadway which is the subject of this agreement for the purpose of taking water from Cypress Creek for use in conjunction with road work. It is further agreed that the old concrete bridge within the County roadway shall not be removed without the consent of Kerr County, and Kerr County may, at its discretion, make any necessary repairs or other maintenance necessary to preserve the said bridge. Kerr ~4~ County also reserves the right to route temporary public traffic across the said bridge ~; ~' and roadway in the event of any emergency which might render the adjacent F. M. Road 1341 over Cypress Creek impassable. Either or both the said Perry Lich or Calvin B. Pfeiffer may construct and maintain a fence across the south end of the County roadway in the proximity of the old Cypress Creek bridge and along the East right of way line of F. M. Road 1341 between approximate Stations 46 and 47 of the centerline of F. M. Road 1341; however Kerr County reserves the right to place and maintain a locked gate south of the old bridge should it be deemed necessary. It is further agreed that nothing herein shall be deemed to constitute any agreement or determination as to the ownership or record title of the lands lying beneath that portion of the County roadway which is the subject of this agreement. Pfeiffer o-o-o-o-o-o-o-o-o-o NO. 13598 APPROVAL OF AMENDMENT OF AGREEMENT BETWEEN KERR COUNTY AND D & L MAINTEP7AIQCE FOR JANITORIAL SERVICE On this the 5th day of February 1979, upon motion made by Commissioner Lich, seconded by Commissioner Guthrie, the Court unanimously approved a written proposal to amendment of the Agreement between Kerr County and D & L Maintenance, for Janitorial Service, that in addition ~~~"i ii '! to the present agreement the proposal includes yard and underground parking area maintenance and enlarged area in basement remodeling and stairs leading to parking area. Effective February 1, 1979, the monthly rate for Janitorial Service will be increased from $1437.00 per month to $1650.00 per month, as set forth in the proposal on file. o-o-o-o-o-o-o-o-o-o NO. 13599 APPROVAL OF PROPOSAL TO PURCHASE ONE COPY MACHINE-CAidON 5000 PLAIN PAPER COPIER FROM UTEX INC. On this the 5th day of February 1979, upon motion made by Commissioner Guthrie, seconded by Commissioner Speakmon, the Court unanimously approved a proposal to purchase a new Copy Machine - Canon 5000 Plain Copier from Utex Inc., in the amount of $8995.00, less trade-in of one 8 year old Royal Bond Copier, presently in use in the County Clerk's Office, in the amount of $1925.00, leaving a net balance of $7070.00, subject to final approval by County Auditor, Don Williamson. And it is further ordered that upon final acceptance of the machine by the County Clerk and the County Auditor, payment for same be made from the General Fund of Kerr County. o-o-o-o-o-o-o-o-o NO. 13600 APPROVAL OF AMENDMENT TO EXISTING AGREEMENT BETWEEN KERB COUNTY AND MOORE SERVICE On this the 5th day of February 1979, upon motion made by Commissioner Lich, seconded by Commissioner Speakmon, the Court unanimously approved acceptance of an amendment to the existing Agreement between Kerr County and Moore Service, and that effective Pdarch 1, 1979, the monthly rate for garbage and refuse collection, will be increased from $900.00 per month to $975.00 per month. o-o-o-o-o-o-o-o-o-o COURT ADJOURNED FEBRUARY 5th, 1979 at 11:50 o'clock A.
