(All Members Present and All Members Voting "AYE"). o-o-o-o-o-o-o-o-o-o NO. 13798 APPROVAL OF 1979 TAX ROLL BY BOARD OF EQUALIZATION On this the 10th day of September 1979, with the County Judge and County Commissioners sitting as a Board of Equalization, did carefully examine the Tax Rolls made up from the approved assessments by Doris Lee Smith, Tax Assessor-Collector for Kerr County, Texas, for the year 1979 and did find that all surveys and parts of Surveys of land, and all lots and 496 blocks of the Cities and Towns of this County and all personal property, insofar as they were able to ascertain have been assessed for taxes for the year 1979, at its true and full market or real value. All members of the Commissioners' Court were present and all voted "AYE". o-o-o-o-o-o-o-o-o-o-o STATE OF TEXAS J( COMMISSIONERS' COURT COUNTY OF KERB X OF KERB COUNTY, TEXAS PETITION TO CLOSE ROAD TO THE HONORABLE COMMISSIONERS' COURT OF KERR COUNTY, TEXAS: WHEREAS, there presently exists an easement and way of access lying in Precinct No. 3, in Kerr County, Texas, being more fully described by beginning point and terminating point in Exhibit "A" attached hereto and called driveway No. 3 and named "Crawford" Street and incorpor~ - ed herein for all purposes. Such way and road has never been utilized as a public road, alley, or passageway or by the public for a~ purpose; AND WHEREAS, such driveway No. 3 (as depicted on Exhibit "A"), while never used by the public for any purpose constitutes a cloud on the title of adjacent Landowners of lots in Blocks 2 and 3 as depicted on the said plat, Exhibit "A"; AND WHEREAS, no persons receive any benefit of ingress and egress to and from their lands by virtue of such Driveway No. 3 (Crawford Street), and further such Driveway No. 3 constitutes an easement across lands of adjacent Lot owners there~~t effectively denying them the use of the surface. of the land which lies within Driveway No. 3/depicted on Exhibit "A", without any benefit to others; AND WHEREAS, it would be to the public interest to close and discontinue such Driveway No. 3 (Crawford Street); NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS: That pursuant to Article 6703, V.A.C.S. and Article 6705, V.A.C.S., each of the under- signed persons or entities, hereinafter called PETITIONERS, being at least eight (8) freeholders in and of the aforesaid precinct in which such Driveway No. 3 (Crawford Street) is desired to be discontinued, hereby respectfully petition the Honorable Commissioners' Court of Kerr County, Texas, hereinafter called the COURT, to discontinue and permanently to close the above mention- ed Driveway No. 3 (Crawford Street), and further to place this matter on the agenda of the Court for action at the first regular or special meeting of the Court occurring as soon as possible after expiration of twenty (20) days from the date of posting of this Petition. PETITIONERS further respectfully allege that such action by the Court would be expedient and would better serve the public interest.
