J1U NO. 13836 RESOLUTION ACCEPTING THE PROVISIONS OF STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION COMMISSION MINUTE ORDER THE STATE OF TEXAS J( COUNTY OF KERB J( KERRVILLE, TEXAS October 8, 1979 MOTION was made by Commissioner Speakmon and seconded by Commissioner Lich that the Kerr County Commissioners' Court accept the provisions contained in Minute Order No. 76184 passed by the State Highway and Public Transportation Commission on August 29, 1979, far the improve- ment by the State Department of Highways and Public Transportation of the roads described below and that Kerr County agrees to furnish all required right of way free of cost to the State: A Spur extending from State Highway 27, 1.4 miles Southeast of Kerrville City Limit, Southeast to Kerrville Airport, a distance of approximately 1.3 miles VOTE on the motion was as follows: JUDGE JULIUS R. STATE DEPARTMENT OF HIGHWAYS AND PUBLIC TRANSPORTATION MINUTE ORDER KERB COUNTY District No. 15 Page 1 of 2 WHEREAS, in KERB COUNTY, Minute Order 72797 provides for construction of a SPUR extending from State Highway 27, 1.4 miles Southeast of Kerrville City Limit, Southeast to Kerrville Airport, a distance of approximately 1.3 miles and WHEREAS, subsequent requirements for modifications to the airport will require relocation of the proposed Spur; and WHEREAS, the City of Kerrville and Kerr County have requested such relocation; NOW, THEREFORE, IT IS ORDERED that Minute Order 72797 and the corresponding item in the 1978 Special Rehabilitation and State Highway Safety and Betterment and Farm to rlarket Road Improvement Program be and are hereby cancelled and the Engineer-Director is directed to tender the following proposal to the City of Kerrville and Kerr County for a proposed project extending from State Highway 27, 2.3 miles Southeast of Kerrville City Limit, Northeast a distance of approximately 1.2 miles: Provided the City and/or County will: 1. Furnish all required right of way clear of obstructions and free of cost to the State with acquisition procedures to be in accordance with applicable State laws governing acquisition policies for acquiring real property. 2. Construct and maintain a road having a design comparable to the proposed project and extending from the end of the proposed project 1.2 miles Northeast of State Highway 27, South to State Highway 27, a distance of approximately 1.7 miles. The State Department of Highways and Public Transportation will: 1. Provide for construction of Grading, Structures and Surfacing at an estimated cost of $402,000. 2. Assume maintenance responsibility after completion of construction. Upon acceptance of the provisions of this Order by the appropriate officials of the City of Kerrville and Kerr County, IT IS ORDERED that a SPUR be and is hereby designated extending from State Highway 27, 2.3 miles Southeast of Kerrville City Limit, Northeast a distance of approximately 1.2 miles and the Engineer-Director is directed to proceed with preliminary ~. l ~', engineering, including preparation of right of way data, and to proceed in the most feasible and economical manner with construction, financing a portion of the cost in the amount of $206,000 with funds released by cancellation of Minute Order 72797 and the remainder in the amount of $196,000 in the next appropriate program. In the event the City and/or County desires the State to include their construction responsi- bilities in the State's construction contract, the Engineer-Director is authorized to enter into agreement with the City and/or County for such work and its cost as may be agreed upon. This Order shall become operative upon acceptance by the City of Kerrville and Kerr County and if not accepted within 90 days of the date hereof, the action herein contained shall be automatically cancelled. The Commissioners' Court further authorizes the sum of $625.00 to be paid as its 25~ cash share of the equipment line item entitled, "Booking Area Camera".
