Herd and Mr. Bill Roden to improve and pave a 2.2 mile section of the Fall Creek County Road in Precinct one at their own expense and at no cost to Kerr County and as per attached construction contract proposal of Edmund Jenschke, inc. dated October 31, 1979; and it appearing to the Court that the offerors are prepared to donate the contemplated cost thereof in the amount of $27,346.56 into the County treasury of Kerr County in the event their proposal to improve the said 2.2 mile section of County roadway as per the bid of Edmund Jenschke, Inc. is accepted by Kerr County, it is ordered on motion by Commis- sioner Guthrie, seconded by Commissioner Garrett and unanimously approved by the Court that Kerr County hereby agrees to accept the letter proposal of Marvin R. Herd and Bill Roden dated November 6, 1979 to improve and pave a 2.2 mile section of the Fall Creek County Road as per attached construction bid proposal of Edmund Jenschke, Inc. dated October 31, 1979, the said acceptance by Kerr County being conditioned on the surveying of the route of the roadway to be improved beyond the point where Kerr County presently holds a recorded road easement and that easements be filed of record giving Kerr County a written road easement for the section to be improved with a normal width of 50 feet; and further that in the event additional construction costs such as drainage pipes or cattle guard relocations are found to be necessary the cost thereof shall be borne by the offerors, either privately or through additional donations into the County treasury of Kerr County; and it is further ordered that all funds donated into the Kerr County treasury shall be deposited in the County Depository in a separate fund to be designated as "Special Road Construction Fund No. 1"; and that any interest accuring from the investment of such funds while in the custody of the County Treasurer of Kerr County shall accrue to the benefit of the said fund; and it is further Id ordered that disbursements from the said fund shall only be made on order of the Commissioners' Court and on approval by the County Auditor of Kerr County, and that all approved payments for work done on the aforesaid project shall be made through the Kerr County Treasury out of the aforesaid Special Road Construction Fund No. 1. o-o-o-o-o-o-o-o-o-o NO. 13867 APPROVAL OF D4ERIT INCREASE FOR PAULA RECTOR, DEPUTY TAX ASSESSOR-COLLECTOR On this the 12th day of November 1979, upon motion made by Commissioner Speakmon,
