Dear Judge RTeunhoffer: We refer to our telephone Conversation of 26 March concerning repair of damage adjacent to the "Flat Rock Dam" on the Guadalupe near Kerrville and propose to provide engineering service as required in association with Mr. Louis Domingaes~ who has already performed most of the field work and part of the general plans. Our agreement with Mr. Domingues,=should we be selected for the assignment, is that his organization would perform field st~srveys, prepare basic plans and supervise construction by such periodic visits as are required to as- sure compliance with the plans and specificationsand would supply such on- site inspection as would be necessary to the same purpose. Our responsibility would be preparation of advertisements bidding docu- ments, detailed design of increments of the work, assistance in receipt of and tabulation of bids and recommendation for award of contract. Our° fee-for the portions of the work to be performed by our forces is ratYer• difficult to define for this mixed up project. We therefore suggest that it be performed on per diem basis at rate of fifteen dollars per hour for the actual time expended but not to exceed two and one half (2~) of the contract amount. Mr. Domingues will submit his proposal for the portion of the work to be conducted by his organization as, under ezisting circumstances, we feel that separate agreements would be to the advantage of the County. ~ brief memorandum of agreement for our portion of the work is attached. Box 126, Camp Wood, Texas, 78833, Telephone 512-597-5555. We have mutually agreed upon a plan which we both considered to be the most logical plan for protecting the East end of the Flat Rock Dam. In accordance with our telephone conversation with you, Mr. Holmes will prepare all papers necessary, including advertising for bids, etc, and preparing specifications. I will do all field work in connection with preparing plans and all engineering for such, including calculating quantities of fill, concrete, etc., and I will prepare the necessary plans for construction and will do all other general engineering supervision. Mr. Holmes will furnish his services on a time basis, at the rate of $15.00 per hour. It is estimated that his fee will amount to approximately $800.00. I will do the engineering and supervision required of me for a fee of 10% of the amount of the bid for construction. In view of the fact that Charles Holmes designed and supervised the con- struction of the previous work of the Training Wall and slabs now in place at the East end of this dam, we know of their design and construction and can more redily tie the new work into the existing works.
