ORDER NO. 13866 ORDER ACCEPTING OFFER TO IMPROVE AND PAVE A PORTION OF THE FALL GREEK COUNTY ROAD IN PRECINCT NUMBER ONE. On this the 12th day of November, 1979 came on to be heard and considered by the Court the written offer of Mr. Marvin R. Herd and Mr. Rill Roden to improve and pave a 2.2 mile section of the Fall Creek County Road in Precinct one at their own expense and at no cost to Kerr County and as per attached construction contract proposal of Edmund Jenschke, Inc. dated October 31, 1979; and it appearing to the Court that the offerors are prepared to donate the contemplated cost thereof in the amount o: $27, 346.56 into the County treasury of Kerr County in the event their proposal to improve the said 2.2 mile section of County roadway as per the bid of Edmund Jenschke, Inc, is accepted by Kerr County, it is ordered on motion. by Commissioner Guthrie seconded by Commissioner Garrett and unanimously approved by the Court that Kerr County hereby agrees to accept the letter proposal of Marvin R. Herd and Eill Roden dated ]November 6, 1979 to improve and pave a 2.2 mile section of the Fall Creek County Road as per attached construction bid proposal of Edmund Jenschke, Inc. dated October 31, 1979, the said acceptance by Kerr County being conditioned on the surveying of the route of the roadway to be improved beyond the point where Kerr County presently holds a recorded road easement and that easements be filed of record giving Kerr County a written road easement for the section to be improved with a normal width of 50 feet; and further that in the event additional construction costs such as drainage pipes or cattle guard relocations are found to be necessary the cost thereof shall be borne by the offerors, either privately or through additional donations into the County treasury of Kerr County; and it is further ordered that all funds donated into the Kerr County treasury shall be deposited in the County Depository in a separate fund to be designated as "Special Road Construction Fund No. 1"; and that any interest ac curing from the investment of such funds while in the custody of the County Treasurer of Kerr County shall accrue to the benefit of the said fund; and it is further ordered that disbursements from the said fund shall only be made on order of the Commissioners' Court and on approval by the County Auditor of Kerr County, and that all approved payments for work done on the aforesaid project shall be made through the Kerr County Treasury out of the aforesaid Special Road Construction Fund No. 1. 1020 Fall Creek Road Kerrville, Texas 78028 November 6, 1979 Kerr County Commissioners Court Kerrville, Texas 78028 Gentlemen: In response to your letter proposal of May 3, 1979 relative to the reconstruction and paving of a portion of the Fall Creek Road, I wish to advise that Mr. Bill Roden and I have requested and received a firm bid from Mr. Edmund Jenschke to reconstruct and pave a 2.2 mile section of the existing road from the end of the existing pavement to a point 200 yards inside the present Roden-Herd property. Attached to this letter is a copy of said bid from Mr. Jenschke. In addition to paying for the work in Mr. Jenschke's bid, we would also pay for the cost of surveying a 50 foot right of way easement which all landowners concerned have agreed to donate to Kerr County. Since this project may involve some reconstruction of fencing of existing property lines, we will take care of this matter at our own private expense. This offer is conditioned upon the work being done by Mr. Edmund Jenschke as per his bid and we propose to donate the cost of this work to Kerr County and have the funds disbursed to the contractor by the County Treasurer of Kerr County upon the satisfactory completion of his work. In order that we might have a more definite understanding of this proposal and with the hope that we ran work out the final details promptly, I would request to meet with the Court at its regular November 12 session, preferably in the afternoon at a time convenient with the Court and when its routine business of the day has been transacted.
