ORDER NO. 13567 ORDER SETTING COUNTY AND PRECINCT OFFICIALS ON SALARY BASIS On this the 8th day of January 1979, at a Regular Term of the Commissioners' Court, with a quorum being present, there came on for consideration the matter of compensation of various County and Precinct Officials of Kerr County, Texas, for the year 1979, as provided for in Article 3912e, Section 6, R.C.S. of Texas. And it appearing to the Court that Kerr County has a population of less than 20,000 inhabitants, according to the last Federal Census and that the interests of the County would be best served if the County Officials and Precinct Officials of Kerr County be paid on a salary basis as provided by law, for the year 1979. Upon motion duly made by Commissioner Garrett seconded by Commissioner Lich and unanimously approved by the Court, it is ordered that the County Officials and Precinct Officials of Rerr County be paid on a salary basis as provided by law, for the year 1979. It is further ordered by the Court that the Clerk of the Court prepare a certified copy of this order and send same to the Comptroller of Public Accounts in Austin, Texas. TJe shall appreciate your sending this order as soon as possible after your Commissioner's Court meets at its first regular meeting. This is needed to determine the basis for the payment of money to your county officers and until it is received, this department cannot either pay your county or your county officers any money. The above request is provided for in Article 3912e, Section 2, R.C.S, which reads in part, "Sec. 2. The Commissioner's Conrt of each county in the State of Texas, at its first regular meeting in January of each calendar year, shall, by order made and entered in the minutes of said court, determine. In counties having a population of less than twenty thousand (20,000) inhabitants ac- cording to the last preceding Federal Census, it shall likewise be the duty of the Commissioner's Court, by its order duly made and entered of record at its first regular meeting in January of each calendar year to determine whether county officers of such county (excluding county surveyors, registrars of vital statistics and notaries public) shall be compensated for the fiscal year on the basis of an annual salary or whether they shall be compensated on the basis of fees earned by them in the performance of their of- ficial duties, and it shall also be the duty of the county clerk to forward to the Comptroller of Public Accounts of the State of Texas on or before the 31st day of January a certified copy of said order of said Commissioner's Court." (Underscoring supplied). Until we have received such order, this department is placed in this position, we can neither pay your county any monies under the provisions of Article 3912e, R.C.S. Sec. 6, (a) in the event your county officers have been placed on a salary basis, nor any fees in the event your county has placed its officers on a fee basis for the calendar year 1979.
