HOLLIMON FOR RIGHT OF WAY FOR LOOP 534 On this the 12th day of May, 1980, came on to be heard and considered by the Court the matter of compensation to be paid Kenneth W. Hollimon as compensation for his conveyance to the State of Texas of a parcel of land required for the construction of Loop 534, which land comprises 3.584 acres of land out of Survey 148 J. A. Southmayd and is designated as Parcel No. 3 of said right of way; and it appearing to the Court that an agreed amount of compensa- tion has been arrived at, it is ordered on motion by Commissioner Speakmon, seconded by Commissioner Lich, and approved by a majority vote with Judge Neunhoffer and Commissioners Speakmon, Lich and Guthrie voting aye and Commissioner Garrett abstaining, that Kerr County offer to pay Kenneth W. Hollimon the sum of $55,000.00 as compensation for land and damages for his conveyance to the State of Texas of Parcel #3 as aforesaid, subject to the delivery and execution of his right of way deed, which deed shall reserve the right of access under the proposed Guadalupe River bridge and across the right of way conveyed, which access shall be for the purpose of ingress and egress from the existing County roadway on the east side of the Loop right of way to the grantor's property lying to the west of the right of way conveyed, and which access shall be at such point or points as may be approved by the State Department of Highways and Public Transportation; and it is further ordered that on approval for filing by the State Department of Highways and Public Transportation of the aforesaid ~ right of way deed and on final title approval a voucher shall be drawn in the amount of $55,000.00 on the Loop 534 right of way fund payable to Kenneth W. Hollimon; provided however that in the event there remain unpaid ad valorem taxes levied against the portion of J. A. Southmayd, Survey No. 148, owned by Kenneth W. Hollimon, Lisa Dawn Merritt, daughter and only surviv- ing heir at law of Oren Eugene Hollimon, deceased; Kenneth W. Hollimon, Ima Sue Hollimon Bauer, James S. Hollimon, John Edgar Hollimon, and Billie Jean Clower Galloway, (the afore- said persons with the exception of Bessie L. Hollimon being the sole surviving heirs at law of Frederick J. P. Allison and wife, Irene Allison, of certain compensation conditionally authorized pursuant to the provisions of Commissioners' Court Order No. 13784 entered on the 24th day of August, 1979; and it appearing to the Court that pursuant to the provisions of said order No. 13784, Kerr County did agree to pay certain additional compensation to A. P. Allison and wife, Irene Allison as a result of their having conveyed a parcel of right of way to the State of Texas for the relocation of a portion of F. M. Road 479, which compensation was to be payable in lieu of severance damages and in the event of an exchange of ownership of two severed remainders of land between the said A. P. Allison and wife, and O. B.
