(PQEMORANDUM OF AGREEMENT - Filed but not recorded) '~ "s o-o-o-o-o-o-o-o-o-o NO. 14165 APPROVAL OF REPEAT OF SILVER VALLEY ESTATES ; On this the 20th day of October 1980, upon motion made by Commissioner Speakmon, seconded by Commissioner Garrett, the Court unanimously approved the REPEAT OF SILVER VALLEY ESTATES, (Recorded in Vol. 4, Page 214 of the Plat Records of Kerr County, Texas, showing all tracts & interior roads to be voided and reverting back to its previous state known as Lot No. 3 of Silver Hills Subdivision, recorded in Vol. 3, page 43, Plat Records of Kerr County, Texas). o-o-o-o-o-o-o-o-o-o NO. 14166 ORDER DIRECTING CONDEMNATION PROCEEDINGS AGAINST IMA SUE HOLLIMON BAUER On this the 20th day of October, 1980, came on to be heard and considered by the Court the necessity of instituting condemnation proceedings against Ima Sue Hollimon Bauer to secure for the State of Texas her undivided one seventh interest in and to an undivided one fifth interest in a parcel of land comprising 0.097 acres of land out of J. A. Southmayd Survey 148 in Kerr County, Texas; and it appearing to the Court that the offer for land and damages made to the said Ima Sue Hollimon Bauer by Kerr County as is evidenced by Commis- sioners' Court Order No. 14008 entered on the 12th day of May, 1980, and recorded in Vol. O, page 564 of the minutes of the Commissioners' Court has been verbally wholly rejected by the said Ima Sue Hollimon Bauer; and it further appearing to the Court that the total rejection ~~ of Kerr County's offer has left Kerr County in a position of being unable to secure clear and full title in the name of the State of Texas as to the said parcel of land; and it further appearing to the Court that further negotiations would be useless and to no avail, it is therefore ordered, on motion by Commissioner Lich, seconded by Commissioner Garrett, and unanimously approved by the Court that Kerr County, acting for and on behalf of the State of Texas, institute condemnation proceedings in the name of the State of Texas against the said Ima Sue Hollimon Bauer of Kerrville, Kerr County, Texas, to secure for the State of Texas for right of way purposes her undivided interest in and to the aforesaid 0.097 acres of land situated in Kerr County, Texas, said parcel of land being designated as Parcel No. 1 and described and shown more particularly on the right of way map of the State Depart- ment of Highways and Public Transportation as made on August 4, 1977 for the right of way for State Highway Loop No. 534 from FM Road 689 north to Interstate Highway No. 10, to which map reference is herewith made; and it is further ordered that County Attorney James C. Nogues be retained to institute such condemnation proceedings and that he be authorized and directed to proceed forthwith on behalf of Kerr County, acting for and in the name of the State of Texas. o-o-o-o-o-o-o-o-o-o NO. 14167 ORDER AMENDING ORDER NO. 14.008 OFFER TO HEIRS OF CLERGY E. HOLLIA2ON, DECEASED FOR RIGHT OF WAY FOR LOOP 534 On the 20th day of October, 1980 came on to be heard and considered by the Court the matter of amending Order No. 14008 entered on the 12th day of D4ay, 1980, and it appearing to the Court that all of the heirs of said said Clergy E. Hollimon, deceased, named in said o~'` order #14008 have executed and delivered the right of way deed concerned except Ima Sue ~~ Hollimon Bauer who has refused to join them, it is ordered on motion by Commissioner Speakmon, seconded by Commissioner Guthrie and unanimously approved by the Court that Kerr County accept the right of way deed executed by six of the seven heirs of Clergy E. AI7D [^7ITHIN THE PROXIMITY OF THE COUNTY JAIL AT ALL TIMES On this the 20th day of October, 1980 came on to be heard and considered by the Court the necessity of prohibiting loitering by individuals or by groups of individuals on the courthouse square during certain hours and in the proximity of the County jail at all times; and it appearing to the Court that in order to provide protection for the public buildings and grounds comprising the courthouse square and in order to provide additional external security for the Kerr County Jail, it has become necessary to prohibit unauthorized loitering at certain times, it is ordered on motion by Commissioner Lich, seconded by Commissioner Garrett and unanimously approved by the Court that effective immediately, loitering by individuals or groups of individuals on the courthouse square be prohibited between the hours of 6:00 p. m. and 7:00 a.m., and in the proximity of the County jail at all times; and it is further ordered that the Sheriff of Kerr County be authorized and directed to enforce the provisions of this order and to file criminal trespassing charges against violators of this order. o-o-o-o-o-o-o-o-o-o ' NO. 14169 ORDER APPOINTING MRS.
