NO. 14181 ORDER CONCURRING IN AGREEMENT OF SETTLEb'iENT AND COMPROMISE IN CAUSE NO. 78-126-B, 198th DISTRICT COURT, RE: CONDEMNATION PROCEEDINGS AS TO RIGHT OF WAY PARCEL IQO. 28 FOR LOOP 534 RIGHT OF WAY -- On this the 10th day of November, 1980 came on to be heard and considered by the Court the matter of concurring in an agreement of settlement and compromise in the condemnation proceedings in Cause No. 78-126-B, 198th District Court of Kerr County wherein the City of Kerrville has heretofore instituted condemnation proceedings in the name of the State of Texas against Pueblo Hills, Inc., the owner of Parcel No. 28 of the right of way Łor Loop 534; and it further appearing to the court that by prior agreement with the City of Kerrville, Kerr County has agreed to assume the financial obligation created by the owners' appeal of the proceedings before the District Court; and it further appearing to the Court that an agreement of settlement and compromise has been reached by the parties of record to the said proceedings whereby Pueblo Hills, Inc., has agreed to dismiss its pending appeal to the Court of Civil Appeals in this cause on certain conditions which include an additional cash payment by Kerr County over and above the District Court's award, which payment is to be in the amount of $2000.00, it is ordered on motion by Commissioner Lich, seconded by Commissioner Guthrie, and unanimously approved by the Court that Kerr County concur in the proposed agreement of settle- ment and compromise including the payment of the sum of $2,000.00 to Pueblo Hill, Inc. by Kerr County; and it is further ordered that upon execution of the agreement of settlement and compromise by all parties of record, a voucher be drawn on the Loop 534 Right of Way Fund in the amount of $2,000.00 payable to Pueblo Hill, Inc. o-o-o-o-o-o-o-o-o-o NO. 14182 APPROVAL OF REPEAT OF FOREST WEST SUBDIVISION SECTION FOUR - PHASE I On this the 10th day of November 1980, upon motion made by Commissioner Garrett, seconded by Commissioner Speakmon, the Court unanimously approved the REPEAT OF FOREST WEST SUBDIVISION SECTION FOUR - PHASE I, (Recorded in Vol. 2, Page 215 of the Plat Records of Y.err County, Texas), a subdivision comprising 6.61 acres of land out of Florentine Lara Survey No. 123, Abstract No. 225, in the City of Kerrville, Kerr County, Texas. ENDING SEPTEMBER 30th, 1930 On this the 10th day of November 1930, in Regular Session of Commissioners' Court, came on for examination the Quarterly Report of Dorothy Smith, County Treasurer of Kerr County, Texas, for the period beginning July 1, 1980 and ending September 30th, 1980, and the same having been examined and compared by the Court and found correct. And it appearing to the Court that during the said time the Treasurer has received for account and credit and paid out of each of said funds as reflected a part hereof; and that said accounts received and paid out of the filing of the preceding report and during the period above stated, in shown.
